New Opportunities Despite Congressional gridlock, some new opportunities : STEM extension of OPT = 3 year work authorization, more than once “Chart B” = early filing dates for PR applicants DACA = extensions available H-4 work permits = spouses of H1B’s qualify for work permits Entrepreneur by parole program = progress towards self-employment

Who qualifies for STEM OPT? A student must have earned a bachelor’s, master’s, or doctoral degree in a major listed in the STEM Designated Degree Program List, which can be viewed at http://www.ice.gov/sevis/stemlist.htm A student working on OPT based on a non-STEM degree may receive the 24 month STEM OPT extension based on a prior STEM degree if s/he has not already received a STEM OPT extension based on that prior STEM degree. A student who has already used 36 months of OPT under the STEM program, and earns another qualifying STEM degree at a higher educational level, is eligible for an additional 24 month STEM OPT extension. The student’s OPT employer must participate in the E-Verify program; and The student’s employer must report material changes to the student’s employment to the office of international students at the student’s school within 5 business days in order to update the electronic SEVIS record.

Can I travel during OPT/STEM OPT? Yes, if: employed in field I-20, visa and work permit unexpired SEVIS records updated and Have work letter from employer in field Longer F visa terms now common Non-immigrant intent still required

What jobs work? OPT = work or volunteer in field of study, at least 20 hours per week, no pay requirements, start up and self-employment acceptable STEM = need employer, training program, salary commensurate with American workers, still commissions and dividends okay H-1B = need ‘specialty occupation,’ salary not counting bonus, commissions or dividends, can’t self sponsor Green Card = typically cannot self sponsor unless a Priority Worker or National Interest Worker

What are my PR options after OPT? Can I go straight from OPT to PR? Yes if STEM eligible + no quota delay + green card process fast (12 to 18 months is normal) How does Chart B affect this timing? Creates “early filing date” for quota delayed applicants, cutting off 1 year+ from waiting time until Adjustment of Status filing (I-485)

“Employment” and “Employer-Employee” Relationship How do I answer “are you authorized to work” questions on a job website? While the technical answer is yes, it is probably best to add that future visa sponsorship may be required, then let the employer ask. Not illegal to simply answer ‘yes’ but may not be in the best interest of a future employer relationship. What should I expect with regards to immigration matters in my offer letter? In our experience, most employers leave OPT processing costs to employee but pay for H-1B processing cost. PR application costs are employer’s or shared. Don’t wait until the job offer to reveal that sponsorship is needed to start the job – discuss in interview

H-1B Nonimmigrant Visas Employer sponsored for up to 6 years in a “specialty occupation” Three Requirements: Job must require a Bachelor’s degree or higher in specific field – USCIS now imposing more exacting standard Beneficiary must have at least the relevant Bachelor’s degree or equivalent Employer must pay a required wage

Procedure DOS CIS DOL Visa Application Apply for visa if need to travel outside US DOS File H-1B Also known as Form I-129 Processing Currently 4-5 months for normal processing time Premium processing possibility is 2 weeks CIS File LCA Employer must pay higher of prevailing or actual wage Post wage at worksite DOL

Advantages of H-1B 1. Duration: 6 year maximum 1 year stay outside U.S. refreshes 6 years Additional H extensions if green card started by end of 5th year 2. Time to work toward green card 3. No advertising or test of the U.S. labor market 4. H-1B portability when change employers 5. Cap-Gap work permit extension 6. Travel and Dual Intent (but visa duration restricted by country)

In certain situations, H-4 dependent spouses can work! New Advantage of H-1B In certain situations, H-4 dependent spouses can work! Effective May 26, 2015, the Immigration Service is extending work authorization to certain H-4 dependent spouses of H-1B nonimmigrants who are seeking employment-based lawful permanent resident (LPR) status. Eligible individuals include H-4 dependent spouses of H-1B nonimmigrants who:  - Are the principal beneficiaries of an approved I-140; or - Have been granted H-1B status beyond the six-year limit based on pending green card applications (pursuant to sections 106(a) and (b) of AC21).

Disadvantages of H-1B 1. Tied to one employer 2. Not flexible like F-1 OPT 3. Paperwork, cost and delay 4. October 1st start date + cap race 5. “Self-sponsorship” not permitted 6. Must work to maintain status 7. Fees: $825 – cap-exempt $1,575 to $2,325 – cap-subject $1,225 – expedite $3,000 approx. – legal fee

What is the H-1B “cap”? 65,000 per fiscal year Reduced by 6,800 allocation for Chile and Singapore Separate 20,000 for U.S. master’s degree or higher

H-1B Cap Exemptions Eligibility: Advantages: College/university employees Related or affiliated nonprofit entities (i.e. university teaching hospitals) Nonprofit research organizations Government research Prior cap H-1B holders Employed “at” cap exempt worksite Concurrent cap-exempt and cap-subject H’s J-1 shortage area waivered doctors Advantages: Lower filing fees No race, no quota Apply any time

O-1A Visa Extraordinary, Outstanding, Excellence O-1A for business, science, education, sports: Prove 3 of 8 criteria: Receipt of a nationally or internationally recognized prize for achievement in field Membership in associations in field that require “outstanding achievement” of their members Material published about applicant in major publications Applicant serves as a judge of others in field Original, scientific, scholarly, artistic, athletic, or business-related contributions of major significance in field Authorship of scholarly articles in field Performing a critical or leading role for - organizations that have a distinguished - reputation Command a high salary in field

PERM Labor Certification A certification from the Department of Labor that a particular position at a particular company is “open” because no qualified U.S. workers are available Employer must complete 5 kinds of recruitment, show ability to pay wage and prepare audit file Takes approximately 1 year Streamlined process for University professors (“Special Handling”)

Fast Track: Non-PERM Green Card Pathways (for EB-1, some EB-2) EB-1 priority workers: EB-1-A Extraordinary ability aliens (self sponsor) EB-1-B Outstanding professors and researchers EB-1-C Multinational executives and managers EB-2 workers: Advance degree with “national interest” waiver (self sponsor) Exceptional ability with “national interest” waiver (self sponsor)

Timing Processing delays and quota delays mean it could take five years or longer to get an immigrant visa! EB-3 and India and China EB-2 frequently have quota backlogs After PERM + I-140 approval, wait for quota delay. “Priority date” must be “current” to file step 3 of green card process and get a green card Priority date is date of PERM or I-140 filing (start date) Current = Priority Date is prior to date in Visa Bulletin May be able to file earlier under new “early filing dates” in Chart B, but no approval until priority date is current. EB-5 Immigrant Investors For investors in U.S. companies that benefit U.S. economy and create or save at least 10 full-time U.S. worker jobs $1 million normally required to invest; $500,000 in rural or poor areas Receive conditional residence for two years; then file again to show job creation and receive permanent green card 10,000 EB-5 green cards per year Quota backlogs for Chinese nationals
