Diligent Search Report (SL-2 Form) Deconstructed The Surplus Line Association of California

Preface One of the primary responsibilities of a surplus line broker is to ensure that a diligent search is performed amongst admitted insurers that write a risk before placing the risk in the surplus lines market. To ensure that the search is performed, the broker must provide a completed Diligent Search Report (SL-2 form) with the policy to the Insurance Commissioner or his/her designee. Because the Diligent Search Report requires detailed information about the risk being placed, the completion of the form remains a problem with the brokers and agents who conduct the search. The purpose of this guide is to break down the eight sections that comprise the SL-2 form. When the sections are deconstructed, it should be easier to focus on what is required to complete the form correctly.

Diligent Search Report: Surplus Line Broker’s Responsibilities Per California Insurance Code (CIC), Section 1763 (a): A surplus line broker may solicit and place insurance for a home state insured, other than as excepted in Section 1761, with surplus line insurers only if that insurance cannot be procured from insurers admitted for the particular class or classes of insurance and that actually write the particular type of insurance in this state. Each surplus line broker shall be responsible to ensure that a diligent search is made among insurers that are admitted to transact are actually writing the particular type of insurance in this state before procuring the insurance for a home state insured from a surplus line insurer. In addition, each surplus line broker shall file a standardized form to be prescribed by the Commissioner setting forth the diligent efforts to place coverage with admitted insurers and the results of these efforts.

Diligent Search Report: Conditions of Placement The person signing the Diligent Search Report (SL-2 form) must be licensed under the requirements of the California Insurance Code. The person signing the SL-2 form must have performed the diligent search or supervised an unlicensed person who conducted the search. It shall be prima facie evidence that a diligent search was conducted among three admitted insurers that write that particular type of insurance when the form has been filed with the Commissioner or his/her designee.

Diligent Search Report: Lower Rate Filing Insurance may not be placed with a surplus line insurer for the purpose of procuring a rate lower than the lowest rate accepted by any admitted insurer. (CIC § 1763 (a),(c))

Diligent Search Report: Tag Violations The Surplus Line Association of California (SLA) is the Insurance Commissioner’s designee for reviewing policies for home state insureds written by surplus line insurers. When documents are incomplete or in violation of the California Insurance Code, the brokers are notified through a tag, stating the error and what needs to be corrected. There are currently 12 tags associated with the SL-2 form. The SL-2 tags comprised 16% of tags generated in 2014.

Diligent Search Report: Breakdown by Sections The SL-2 form is composed of nine sections, but three of the sections are only required if applicable to a specific types of policies: Section 1—the licensee who conducted or supervised the diligent search. Section 2—details of the insured and risk Section 3—for private passenger auto only Section 4—for health insurance only Section 5—for risk purchasing groups only Section 6—documents the effort to place with admitted market Section 7—documents the three admitted carriers approached Section 8—documents why risk was not submitted to three admitted carriers if section 7 was not completed Section 9—signature and date

Diligent Search Report: Section 1—Identifying Licensee Line 1: enter first and last name of individual licensee who performed or supervised diligent search. Organizational name is not acceptable on line 1. 1 (A) through (D): enter individual license number or organization name and organizational license number.

Diligent Search Report: Section 2—Insured Information 2(A): Enter name of insured Name should match the name of insured on policy declaration page, certificate, binder or cover note Name should match the name of the insured on the Confidential Report of Placement (SL-1 form) 2(B): Enter mailing address of insured 2(C): Enter the risk being insured, such as building, home Do not enter the type of coverage 2(D): Enter the physical location of risk P O Boxes are not acceptable. If you have entered a P O Box on 2(B) do not state Same as Above for 2(D). 2(E): Enter insurance code from page 3 of instructions.

Diligent Search Report: Sections 3-5 Only if Applicable Section 3(A) through (C): Only complete if coverage is private passenger auto liability. Section 4: Only complete if health insurance is purchased*. Section 5: Only complete if coverage was placed with a risk purchasing group.

Diligent Search Report: Section 6—Description of Diligent Search Effort Section 6(A): Enter a description of how the diligent search was performed. Describe your efforts to place this risk with admitted insurers. Do not enter “See 7(B)”; description of search efforts must be provided. Captive agents* are still required to ensure a diligent search of the admitted market was performed Search must be performed for all new and renewal policies: Even if insured wants to remain with the surplus line insurer, the statute requires that a diligent search be performed Section 6(B): Only enter the first and last name of person who performed the diligent search if other than person named on line 1. *Captive agents can still perform the diligent search by researching through the internet, discussing the market with wholesalers and other agents, or years of knowledge from industry experience. In our experience, the captive agent would skip section 7(B) because they did not submit an application to three admitted insurers and complete section 8(A) and 8(B) or 8(A) and 8(C).

Diligent Search Report: Section 7—Submission to Three Admitted Insurers If you checked the YES on 7(A), proceed to 7(B). If you checked the NO , skip to 8(A). Enter full name of admitted company name or NAIC number in the first block so the SLA can identify the exact admitted insurer contacted. The admitted insurer must be authorized in California for the type of risk being placed. https://interactive.web.insurance.ca.gov/webuser/idb_co_list$.startup An insurer listed on the AM Best Guide does not automatically mean it is an admitted insurer in California for that coverage. Enter the first and last name of the company representative and their phone number, or the insurer’s website address in the second block. The company representative’s email address is not acceptable.

Diligent Search Report: Section 7—Submission to Three Admitted Insurers (Continued) If you entered the name of the company representative on the second block, check if the representative is an Employee (E) or Agent (A) in the third block. If you entered the insurer’s website address, skip this step. Enter the month/year of declination in the fourth block. A current search should be performed within one year from the policy effective date. Enter one of four declination codes on the fifth block. 1-Company capacity reached, 2-Underwriting reason, 3-Refused to state, 4-Other

Diligent Search Report: Section 8—If Risk was Not Submitted to Three Admitted Insurers Section 8(A) through (C): Only complete if Section 7(A) and 7(B) were not completed and risk was not submitted to three admitted insurers. 8(A): If you checked the YES , then skip to 8(C) and state how you determined that fewer than 3 admitted insurers write the type of insurance described on 2(C) and 2(E). 8(A): If you checked the NO , then on 8(B) state why the risk submitted to less than three admitted insurers that write the type of insurance.

Diligent Search Report: Section 9—Signature and Date Form must be signed by licensee named on line 1. Digital signatures are only acceptable if listed on the Secretary of State’s List of Approved Digital Certification http://www.sos.ca.gov/administration/regulations/current-regulations/technology/digital- signatures/approved-certification-authorities Date of signature must be after the search date, and the search date must be prior to effective date of the policy. Date of signature should not be prior to the month/year of declination on Section 7(B). The form must be signed after the diligent search was performed.
