Insurance Provided by OYSA: General Liability Secondary Medical – Accidental Injury Director’s and Officers

General Liability Insurance Who is covered? OYSA Member Clubs and Affiliates Officers, directors, and volunteers Coaches, players, and teams Volunteer EMS Employed Medical Trainers

General Liability Insurance When is coverage provided? A covered person/organization acting on behalf of OYSA A covered person/organization when engaged in an activity sanctioned by OYSA

General Liability Insurance What kinds of claims are covered? Liability that comes from covered activities (previous slide) for bodily injury or property damage to: Spectators Participants General Public

General Liability Insurance Examples of activities that are covered: Activities necessary or incidental to practices, games, or exhibitions Liability from the ownership of outdoor fields that are: Owned by an OYSA member or affiliated club, Exclusively used by the member or affiliate, While acting on behalf of the Association

General Liability Insurance Examples of activities that are covered: Hired and non-owned auto, while being used in the business of the named insured. [Important note: Excludes coverage for any driver transporting athletic participants]

General Liability Insurance Examples of activities that are covered: Liability for false arrest, detention or malicious prosecution, libel, slander, defamation of character, or wrongful eviction Products liability for food or drinks sold on premises

General Liability Insurance Examples of activities that are covered: Fundraising, meetings, awards banquets. Host Liquor liability for banquets and meetings

General Liability Insurance Coverage Limits: $1 million per occurrence No aggregate for most claims Special limits for some claims Brain injury per occurrence $2 million Brain injury aggregate $5 million Sexual Abuse per occurrence $1 million Sexual Abuse Aggregate $2 million

General Liability Insurance Coverage Limits: Products liability (food) $1 million per occurrence $1 million aggregate Damage to property you rent $300,000 per occurrence $300,000 aggregate Excess Liability Coverage $4 million $4 million aggregate

Secondary Medical – Accidental Injury Who is covered: Registered - Players, coaches, managers, other team officials, and volunteers of the teams and clubs participating in Association activities Players participating in approved try-outs Referees

Secondary Medical – Accidental Injury What is covered: Claims for injury resulting directly and independently of all other causes from accidents occurring while participating in covered activities.

Secondary Medical – Accidental Injury What is covered: Covered activities include: Scheduled games, practice, tryouts, and other sponsored activities under the direct supervision of a team official Participation in sanctioned local or national tournaments as a member of a contestant team Organized and supervised group travel directly to and from a covered event

Secondary Medical – Accidental Injury What is NOT covered: Intentionally self-inflicted injury Air travel – except as a fare paying passenger on a regularly scheduled flight of a regularly scheduled airline Injuries from non-covered events Sickness – except an infection from an accidental wound

Secondary Medical – Accidental Injury Coverage Limits Maximum benefit $100,000 Deductible per claim - $500 20% co-insurance on all payable benefits Physical Therapy Limit - $50/visit, $2,000 maximum Chiropractic spinal treatment limit - $50/visit, $2,000 maximum

Secondary Medical – Accidental Injury Loss Period Treatment must begin not later than 180 days after a covered accident Benefits payable for not more than 104 weeks after a covered accident

Secondary Medical – Accidental Injury Additional Accidental Death & Dismemberment Benefits Death - $5,000 Loss of two members - $5,000 Loss of one member - $2,500 Member = hand, foot, or eye Loss = complete separation above ankle or wrist; or complete and irrecoverable loss of vision

Secondary Medical – Accidental Injury Secondary Coverage Insurance is “excess” Payable only after primary applicable insurance has completed payment Claimant must follow the rules of primary insurance, or benefits will be reduced to 50% This insurance can be primary only if there is no other applicable insurance

Directors and Officers Insurance Who is covered Listed OYSA member clubs for the current year. Listed clubs is a list compiled by OYSA for those organizations that renew or are accepted as new member clubs by April 15th for the OYSA fiscal year that begins July 1st. Individual officers and directors of member clubs

Directors and Officers Insurance What claims are covered D&O wrongful acts: Act, error, omission, misstatement, misleading statement, neglect, breach of duty or Personal & Advertising Injury committed or attempted by an individual insured in his/her capacity as an individual insured; or by the Organization; or ***an individual insured while serving as a director, officer, governor, or trustee of an Outside Entity at the written requests or direction of the Organization Outside Entity: A not for profit entity as described in Section 501(c) of the Internal Revenue Code An entity listed in the policy by endorsement
