Tackling Drink Driving

Legislation Road Traffic Act 1988, section 5: Drive, attempt to drive, or be in charge of a motor vehicle on a road or other public place whilst the proportion of alcohol in your breath, blood or urine exceeds the prescribed limit. Applies GB wide

Police Power to Require a Breath Test A Constable can require any person who they have reasonable grounds for believing is or has been: driving, attempting to drive or in charge of; a motor vehicle; on a road or other public place when the constable suspects that the driver has; alcohol in their body, has committed a moving road traffic offence or who has been involved in a collision; to provide a specimen of breath for a breath test. It is an offence to fail to provide a specimen of breath for a breath test without reasonable excuse.

Penalties If someone is charged and found guilty of a drink driving offence, in addition to a criminal record, the following penalties may apply; Driving or attempting to drive – 6 months imprisonment, up to £5000 fine & a driving ban for at least 1 year (3 years if convicted twice in 10 years). Refusing to provide a specimen of breath, blood or urine for analysis – 6 months imprisonment, up to £5000 fine, a ban from driving for at least 1 year. Causing death by careless driving when under influence of drink – 14 years imprisonment, unlimited fine, a ban from driving for at least 2 years.

Reduced limit introduction Following transfer of the power to set drink drive limit from Westminster to Scottish Parliament, the Scottish Government published consultation paper, “Reducing the Drink Driving Limit in Scotland” Consultation ran from 6 September to 29 November 2012 138 responses Thereafter: During October 2014 Scottish Government officially announce (pending approval of Parliament) plans to introduce drink drive limit As a result…… 102 Supported reduction.

Success? Drink Driving - Scotland (Management Information Figures) - 6.8 % 7.9% reduction when you take into account all (in charge/FTP etc) – Figures above only relate to drive offences.

Results: Caught in the Gap Festive period 2014/15 = 20 (351) Festive period 2015/16 = 19 (459) 42 cases from total of 491 prosecuted by COPFS between 6/12/14 & 23/2/15 were over new but under old limit. Still 3 times more likely to die in a crash at new limit.
