EDUCATION BENEFIT PROGRAMS Entitlement The number of months and days of full-time benefits an individual originally receives or has remaining. Maximum of 36 months for veterans eligible for MGIB programs & Post 9/11 GI Bill (CH30 and CH33 may be extended to end of term). DEA provides 45 months, VR&E affords 48 months. Maximum of 48 months under any combination of programs (Example: If a claimant used 36 months under MGIB chapter 30, they may use an additional 12 months of Chapter 1606 or 1607 benefits). Entitlement charged based on Training Time (Rate of Pursuit for CH33) and the actual period the student attended (IHL/NCD). Entitlement can be transferred under the Post 9/11 GI Bill Transfer of Entitlement (TOE) program. TOE entitlement can also be taken back. Cannot receive benefits under more than 1 program at a time.

EDUCATION BENEFIT PROGRAMS Eligibility Period Period of time during which benefits may be paid to an eligible individual with remaining entitlement. “Delimiting Date”: The first day after a claimant's period of eligibility expires.  Benefits are not payable on or after the delimiting date. Period of eligibility varies by program. CH1606, CH1607 and CH35 Delimiting Dates may be extended to the end of the term. Delimiting Dates may be extended for a disability that prevented training. May be extended for additional active duty periods.

Montgomery GI Bill®– Active Duty (Chapter 30) First entered active duty after 6/30/85 or entered active duty before 1/1/77 & remained on active duty until sometime after 7/1/85. Did not decline the MGIB or accepted it during an open season. Had military pay reduced by $1,200. Entitlement is generally 36 months of full time benefits payments. Delimiting date is 10 years after last release from active duty.

Montgomery GI Bill® – Active Duty (Chapter 30) Programs include college degrees, non-degree technical programs, flight training, correspondence courses, OJT & apprenticeship, licensing & certification exams. Did not decline the MGIB or accepted it during an open season Claimants apply with VA Form 22-1990 and thereafter with VA Form 22-1995 for subsequent programs. Post-9/11 GI Bill®– (Chapter 33) Program came into effect August 1, 2009 Provides up to 36 months of education benefits, generally payable for 15 years following the release from active duty Has provision for some servicemembers to transfer entitlement Requires election and may require student to relinquish another Education Benefit Yellow Ribbon Program may be available for some students who are eligible at 100% level

Post-9/11 GI Bill®– (Chapter 33) Service Requirements: Served on active duty on or after 09-10-01 Served a minimum of 90 aggregate days (excluding entry level and skill training), or Service Connected Disability discharge: eligible if served at least 30 continuous days on active duty Active duty served as a member of the Armed Forces or as a result of a call up order to active duty from a reserve component under section 688, 12301(a), 12301(d), 12301(g), 12302, or 12304 of Title 10 is qualifying active duty service or under special approved positions of Title 32 (beginning October 1, 2011)

Post-9/11 GI Bill®– (Chapter 33) Payments under Chapter 33 are prorated based on a student’s eligibility level. The eligibility level is determined based on Aggregate length of credible active duty after September 10, 2001: *The 70/80% rule is as follows: If the aggregate service including training is at least 24 months (730-909 days) but less than 30 months (910-1094 days) AND the aggregate service excluding training is at least 18 months (545 to 729 days) but less than 24 months, the individual will be deemed eligible at the 70% benefit level.

Post-9/11 GI Bill®– (Chapter 33) There are 3 primary payments under the Post 9/11 GI Bill (Chapter 33) Net Tuition and Fees (and Yellow Ribbon) paid to the school* Private Schools and Non-Degree Schools have an Annual Cap (adjusted each school year, Aug. 1st to July 31st) Public School will receive In-State Tuition and Fees. Books and Supplies Payment paid to the student* Books and Supplies is a maximum of $1000 per school year. Monthly Housing Allowance paid to the student* Payment issued at the end of each month of attendance. Monthly Housing Allowance (MHA) is based on school location, Rate of Pursuit (ROP), and type of training (Distance or In-Residence). Active duty students and TOE spouses of active duty members not eligible for MHA. * All payments are subject to the student’s Eligibility Level.

Transfer of Entitlement (TOE) Eligibility Any member of the Armed Forces (active duty or Selected Reserve, officer or enlisted) on or after August 1, 2009, who is eligible for the Post-9/11 GI Bill, and: Has at least 6 years of service in the Armed Forces on the date of election and agrees to serve 4 additional years in the Armed Forces from the date of election. Has at least 10 years of service in the Armed Forces (active duty and/or selected reserve) on the date of election, is precluded by either standard policy (service or DoD) or statute from committing to 4 additional years, and agrees to serve for the maximum amount of time allowed by such policy or statute. DOD determines the eligibility to transfer entitlement. VA only pays the benefit once the transfer is approved.

Transfer of Entitlement (TOE) Eligible Dependents An individual approved to transfer an entitlement to educational assistance under this section may transfer the individual’s entitlement to: The individual's spouse. One or more of the individual’s children. Any combination of spouse and child. A family member must be enrolled in the Defense Eligibility Enrollment Reporting System (DEERS) and be eligible for benefits, at the time of transfer to receive transferred educational benefits. A child's subsequent marriage will not affect his or her eligibility; however the veteran/servicemember retains the right to revoke or modify the transfer at any time. The veteran/servicemember retains the right to revoke or modify the a transfer to a spouse or former spouse at any time.

Transfer of Entitlement (TOE) An eligible Service member may transfer up to the total months of unused Post-9/11 GI Bill benefits. Family members will receive benefits at the same Eligibility Level as the veteran/servicemember. Family member use of transferred educational benefits is subject to the following: Spouse: May start to use the benefit immediately. Is not eligible for the Monthly Housing Allowance stipend or Yellow Ribbon while the member is serving on active duty. Can use the benefit for up to 15 years after the service member’s last separation form active duty. Child: May start to use the benefit only after the individual making the transfer has completed at least 10 years of service in the Armed Forces. May not use the benefit until he/she has attained a secondary school diploma (or equivalency certificate), or reached 18 years of age and is not eligible after reaching age 26. Is entitled to same benefits as the veteran would be.

Dependents’ Educational Assistance Program – DEA (Chapter 35) Child, spouse, surviving spouse of veteran who died in line of duty on active duty, is totally and permanently service-connected disabled, died of service-connected cause, or died while totally and permanently service-connected disabled. Entitlement is 45 months of full time payments. Delimiting date is 10 years from date of eligibility for spouses and 8 years from date of eligibility for children, but (for children) not beyond age 31.

Montgomery GI Bill® – Selected Reserve (Chapter 1606) The reservist must have an obligation to serve for a period of not less than 6 years after 6/30/85. Have a high school diploma or equivalent. Completed Initial Active Duty Training (IADT). Member must maintain satisfactory participation. Entitlement is 36 months of full-time benefits. Public Law 110-252 eliminated the 14-year period of eligibility for individuals to use benefits. (S)he will remain eligible until either exhausting entitlement or DOD/DHS reports that (s)he is no longer eligible.

Recent Department of Defense Changes to Tuition Assistance Program The Department of Defense (DoD) recently announced that they will no longer authorize Tuition Assistance for classes for which a member is also receiving benefits under the Montgomery GI Bill – Selected Reserve program (chapter 1606 of title 10, United States Code) and the Reserve Educational Assistance Program (chapter 1607 of title 10, United States Code). Schools should no longer be providing VA with certifications for classes under chapter 1606 or 1607 if the member is also using Tuition Assistance to pay for all or part of the class.
