M/536: Non-regulated frequencies (e.g. below 9 kHz) Duties of manufacturers (as discussed in RSCOM-TCAM#3 (8 October 2015)) Article 7 of the RED requires Member States to allow the putting into service and use of radio equipment if it complies with the Directive. Member States may introduce additional restrictions on certain grounds, including the effective and efficient use of the radio spectrum. Article 10.2 requires manufacturers to ensure that radio equipment shall be so constructed that it can be operated in at least one Member State when placing it on the market. As the Radio Spectrum Decision (676/2002/EC) does not provide for Community harmonisation measures below 9 kHz, restrictions in these bands can only be introduced by individual Member States. © ETSI 2011. Non-regulated frequencies (e.g. below 9 kHz) ETSI therefore assumes that equipment may be: placed on the market throughout the Community unless all Member States have introduced National restrictions preventing its use, and operated in Member States that have not introduced such National restrictions. ETSI further assumes that: Harmonised Standards contain requirements in order to enable compliance with essential requirements (article 3) to be presumed Harmonised Standards do not address restrictions on the use of equipment (article 7) nor the duty of a manufacturer to place on the market equipment which can be used in at least one Member State (article 10.2) Nevertheless, Harmonised Standards should not be produced for radio equipment that is known to only use frequencies that are forbidden in all MS. © ETSI 2011. Summary of major concerns Need to improve EC/ETSI process for review of Harmonised Standards for citation in the OJEU Current process requires frequent changes to ENs post adoption, which: Create delays in citation, with a risk that HS are not cited in time Create a mis-match between the versions adopted (and transposed into National standards) and versions cited in the OJEU ETSI requests that EC assess standards during Public Approval, allowing their comments to be taken into account in a timely & transparent manner Explore the possibility to cite a published HS with a time limit (2 years?) identified in the OJEU to resolve any mis-alignment with the Vademecum. © ETSI 2011.
