Patent troll ECONOMIC GROWTH 경제학과 200911025 박상학

What is a patent troll? Patent troll is a pejorative term used for a person or company that holds and enforces patents in an aggressive and opportunistic manner, often with no intention of marketing or promoting the subject of the patent.

Profit process of a patent troll Ask for Royalty_ _First, the company asks for royalty against the firm that infringed the patent. Suit the company _Second, if the company rejects the license, patent troll can suit the company Permanent Injunction _Last step is to use "permanent injunction" to wheel up a lot of money. patent troll's main goal is not to settle, but to make a lot of money.

The social background of Patent troll's appearance is ….? 1. patent is registered improvidently. It is harder to reject a patent filing if its permissible range is wider and improvident. This gives greater power to Patent troll when an improvident judge grants a patent. 2. the obscurity of judgement Patent law suit can be very expensive because the judgment of a judge and the jury can be unpredictable and inconsistent. Since this process requires a lot of money, companies that get involved in patent infringement lawsuit try to settle the suit by paying a big chunk of money to Patent Troll.

The problems of a patent troll 1. A wide ranged exercise of right aiming for monetary profit 2. Application of industrial property shrinking 3. It is against the purpose of the establishment of international standard 4. Weakening of price competitiveness and profitability due to royalty 5. Damage occurred due to patent suits in and outside the nation
