Contractual Obligations Comply with Safety and Security Requirements Alberta Construction Safety Association COR Security protocols, criminal record checks (e.g. courts, schools, hospitals) Pre-qualifications (e.g. asbestos) Prime Contractor Typically the GC on new build Typically the Property Manager on operational buildings Comply with Facility Emergency Response Plans (FERP) Bonding (Performance) Insurance Do not qualify insurance requirements CHECK THE CONTACT PROVISIONS

FOIP Act Contractors providing services for public bodies must follow FOIP rules Records about the services provided, not about the contractor’s own operations. Prompt Pay Recognize this is a significant issue AI participation on Alberta Construction Association ad-hoc prompt pay committee Trade contractors coalition Two areas of focus Timely payment of progress claims Progressive release of holdback

Progress Claims Changes to Alberta Infrastructure Contracts Clearer invoicing requirements AI will pay verified amount within 30 calendar days of receipt of invoice Modified Stat Dec includes that GC pay the subcontractors within 10 days of receipt of payment from GoA Subcontractor access to GoA payment information 1-844-252-5322

Progressive Release of Holdback Upon application, holdback funds will be released once the portion of the work is complete AI verify substantial performance After 45 day period, contractor applies for release as part of next progress claim Warranty still from date of Interim Acceptance

Contract Close Out Collaborated with the Alberta Construction Association Timely delivery of contract close out documents (O & M Manuals, Record Drawings) Improvements to contractual specifications: Mark-up drawings to be a standing agenda item for Progress Meetings Contractor to include each Close-out Procedure activity in the Project Schedule and Project Meetings A payment condition percentage will be applied on a sliding scale based on project dollar value
