State Legislative Update Housing bills introduced in the current session of the California State Legislature  

SB 2 (Atkins) The Building Homes and Jobs Act Establishes a permanent funding source for affordable housing through a $75 fee on real estate transaction documents. The fee is capped at $225 on a per parcel, per transaction basis, and exempts commercial and residential sales. Part of State Senate’s “California Rebuild” infrastructure package

SB 3 (Beall) Affordable Housing Bond Act of 2018 Provides $3 billion through a statewide housing bond to fund existing critical and successful affordable housing programs in California. Part of State Senate’s “California Rebuild” infrastructure package

SB 35 (Wiener) Housing Accountability and Affordability Act Streamlines approval process for certain housing in jurisdictions not meeting their Regional Housing Needs Assessment (RHNA). Applies only to housing at income levels for which RHNA is not met (i.e., only applies to low-income housing if a jurisdiction has built its market-rate RHNA). All jurisdictions, including charter cities, must prepare annual housing element progress reports to HCD.

SB 136 (Leyva) Mobilehome Park Rehabilitation and Resident Ownership Program Fund Authorizes HCD to contract directly with nonprofits with statewide or regional capacity to deliver technical assistance to other nonprofits or mobilehome park resident associations in order to assist them in acquiring, financing, operating, and improving mobilehome parks occupied by low- and moderate-income households.

AB 30 (Caballero) Planning and Zoning Specific Plan: Housing By-right development of housing in certain under-performing areas identified by a specific-plan

AB 45 (Thurmond) School Employee Housing Assistance Grant Program Requires CalHFA to create and administer a $100 million program to provide financing assistance to school districts and to developers for the creation of affordable rental housing for school employees. This would be a general fund allocation.

AB 71 (Chiu) Bring California Home Act Provides an additional $300 million worth of state LIHTC credits to be funded through eliminating the mortgage interest deduction on second homes.

AB 72 (Santiago, Chiu) Increased Enforcement of Existing State Housing Laws Appropriates funds to the Attorney General (AG) to enforce existing state housing laws (i.e. Housing Element Law, Housing Accountability Act).

AB 73 (Chiu, Caballero) Spur production of high-density transit- oriented housing Spurs production of housing on infill sites around public transportation by incentivizing local governments to complete upfront zoning and environmental review and reward them when they permit housing.

AB 74 (Chiu, Santiago) Housing for a Healthy California Creates the Housing for a Healthy California program to pay for the cost of housing chronically homeless individuals on Medi-Cal who receive services through the Whole Person Care pilot program, Healthy Homes, or another county controlled funding source.

AB 53 (Steinorth) Homeownership Savings Accounts Allows Californians to deduct from their pre-tax income savings for "Homeownership Savings Accounts" to incentivize savings towards the purchase of a new home in California.

AB 59 (Thurmond) Local Housing Trust Fund Provides funds for affordable housing to cities, housing trusts, land trusts and Habitat for Humanity.

Regional Policy Update  

Plan Bay Area 2040 Prioritizing Affordable Housing at the Regional Level Plan Bay Area 2040 is a planning process to guide $309 billion worth of transportation investments to support compact growth in the Bay Area through 2040. NPH successfully advocated for linking discretionary regional streets and roads funding to local compliance with the State Surplus Land Act – One Bay Area Grants (OBAG). MTC to convene Committee for Affordable and Sustainable Accommodation (CASA Initiative).
