RCC PRELIMINARY POSITION ON THE ITRs (C-94 and C-95 for 7th CWG WCIT-12) 4 5

MOST IMPORTANT DIRECTIONS OF THE RCC COMMON PROPOSALS FOR THE WORK OF THE WCIT-12 ITRs 1 SECURE 2 MODERN TELECOM 3 TRANSPARENT 4 6 6

SECURE TELECOMMUNICATIONS Strengthening Confidence and Security in the Provision of International Telecommunication Services NEW ARTICLE 8: Confidentiality of information (item 8.2) Personal data protection (item 8.3) Combating against spam (item 8.5) Combating against fraud (item 8.6) Correct use of numbering, naming, addressing and identification resources (item 8.7) ARTICLE 3: Correct transmission of the calling party numbering/addressing/naming/identification (item 3.4) 4 7

MODERN TELECOMMUNICATIONS Covering modern International telecommunication services on modern Telecommunications networks Provisions suitable for: Safety of life telecommunications in International telecommunication services (Article 5) Mobile networks/roaming IP-networks Competing (including at global level) mechanisms for allocation of numbering, naming, addressing and identification resources (new items 3.4 and 3.6) 4 8 8

TRANSPARENT TELECOMMUNICATIONS Services transparency Tariffs transparency (especially for roaming) Charging and accounting transparency Emergency services calling transparency Caller ID transparency 4 9 9

TRANSPARENT TELECOMMUNICATIONS International Telecommunication Services It is essential to list specific basic international telecommunication services in the ITRs (item 4.2) in order to: Avoid confusion in taxation of international telecommunication services so that item 6.1.3 is applied to a number of “new” services that have become ubiquitous and traditional; Ensure continued availability of traditional services taking into account Resolution No.6 (final acts of WATTC-88); Make no change in the definition of “international telecommunication service” (item 2.2.) as it is defined in the Constitution. 4 10 10 10

TRANSPARENT TELECOMMUNICATIONS Charging and accounting transparency Basic charging and accounting principles are still relevant and stood the test of time. They are widely used when special arrangements have not been concluded between administrations/operating agencies; Charging and accounting provisions are integrated by indirect reference into large numbers of agreements. ITRs support a stable platform for negotiations reflected in hundreds of agreements affecting billions of dollars; ITRs shall clearly regulate taxation of international telecommunications services including payments through specialized payment agencies, so that double taxation is avoided (item 6.1.3); Maintaining basic charging and accounting principles in the international treaty is crucial for maritime communications; Charging and accounting provisions (Article 6, Appendices 1 and 2) should be modified and maintained in the international treaty as they are widely used to ensure financial discipline of the parties. 4 11 11 11

Avoid duplication/repetition of the provisions Simple ITRs? Avoid duplication/repetition of the provisions Bad case – Member State in accordance with the relevant Articles of the CS/CV, in accordance with national law shall ensure (something), taking into account of relevant Recommendations. Good case – Member State shall ensure (something) All general provisions have to be collected at once in Article 1 - Purpose and Scope of the Regulations or in the Preamble 4 12 12

Regulatory obligations on Member States Powerful ITRs! ITRs prevail over National Regulations for International Telecommunications Regulatory obligations on Member States 4 13 13
