Dedicated Pile Driver Operator Certification Program

Dedicated Pile Drivers Meets OSHA’s definition of a crane: “power-operated equipment, when used in construction, that can hoist, lower and horizontally move a suspended load. OSHA’s definition of the equipment covered under Subpart CC specifically includes “dedicated pile drivers”

Remaining Issues for Fed-OSHA Do operators have to be certified according to the capacity of the crane? OSHA RESPONSE: NO. Does certification = qualification? OSHA’S INITIAL RESPONSE: YES INDUSTRY’S RESPONSE: NO.

Regulatory Agenda Crane Operator Qualification Stage: Proposed Rule (NPRM) Action Date: NPRM by February 2017 New Deadline Approaching NPRM complete Needs OMB (Office of Management & Budget) review

Regulatory Agenda Once Proposed Rule is Published Comment period Public hearing possible/likely May need cost impact study (SBREFA) Before Final Rule can be Published Comments responded to Preamble to be written OSHA committed to completing rulemaking by Nov. 2017 At least two options available to OSHA if deadline missed Further extension (but also would need rulemaking) “Non-enforcement” Memo to OSHA Compliance Officers

What if OSHA does nothing? Regulatory Agenda What if OSHA does nothing? The existing rule as written goes into effect.

Regulatory Agenda “We will ensure that, no matter what the outcome of this industry dialogue, every crane operator holding a current CCO certification card will still have a valid certification, in full compliance with federal requirements...” - Thom Sicklesteel, NCCCO President

Proposed Amendments Forklifts: Change language so they must be equipped with a telescoping jib and hoist to be covered by the rule Proximity Alarms/Insulated Links Change requirements since neither type has been accepted by a “nationally recognized testing laboratory” as required by the rule Power Line Clearance Clarify meaning of “demarcation of boundary”; standardize on “minimum clearance distance” Add Omitted Definitions Digger derrick, duty cycle, multi-purpose machine, repetitive lifts Materials Delivery Exclusion Clarify when articulating cranes used in materials delivery are excluded Hand Signals Amend Appendix A to correct an error in chart Grammatical Revisions Restore “must” in certain places where it had been replaced by “shall” Stabilizer Position Sensor/Monitor Not required for all Articulating Cranes 27

Certification Makes a Difference! Cal-OSHA CRANE ACCIDENTS, June ’02-’05 vs. June ’05-’08 FATAL ACCIDENTS ’02-’05 ’05-’08 High-Voltage line contacts 5 1 Struck by Loads 4 0 Mobile Cranes Overturned 1 1 Total Cases 10 2 80% decrease NON-FATAL ACCIDENTS ’02-’05 ’05-’08 High Voltage Line Contact 7 4 Struck by Loads 18 3 Mobile Cranes Overturned 5 6 Total Cases 30 13 57% decrease [ US CRANE STATISTICS: IT’S WORKING! Finally, the results are in. Just as we hoped two decades ago, certification (and the training that goes along with it) can save lives and protect those who work in, with and around cranes. Cal-OSHA’s study published July 2008 reveals a reduction in crane fatalities and injuries remarkably similar to those Ontario experienced thirty (30) years ago. California introduced CCO-based certification in June 2005. NCCCO has certified over 11,000 crane operators in the state in the first three (3) years of mandatory certification there. [ 28

Other Crane Operator Issues to Ponder

Lift Director Qualification Mentioned once in Subpart CC Referenced 44 times (!) in Compliance Directive Five times in the Recombined Cal-OSHA Rules Regional OSHA offices now issuing citations Project Owners, Utilities mandating

The Aging Workforce Average age of CCO Candidates: All CCO certificants: 43 All Mobile Crane certificants: 44 Telescopic boom fixed cab: 43 Lattice boom crawler crane: 46 Tower Crane: 46 Digger Derrick Operator: 47 Articulating Boom Loader: 37 Crane Inspectors: 50 Lift Director: 55
