SB 415 Overview Approved by Governor September 1, 2015 Adds Sections 14050-57 to the Elections Code Titled “California Voter Participation Rights Act” Takes Effect January 1, 2018
Effect on Jurisdictions Odd year elections or elections other than those held in June or November are not “statewide elections” June or November even-year elections are “statewide elections” New Elections Code section 14052 prohibits local jurisdictions from holding elections on Non statewide date if: Turnout in any one of the four previous elections is 25% less than the average of the last four statewide elections
Benefits Maximizes turnout potential (November statewide elections have highest participation) Election costs likely to be lower since more entities have elections on this date and costs will be spread over larger group Prevention of potential lawsuits under “Rights of Voters” and “Voter Participation”
