Statutory Transition Scheme Responses to earlier consultation were all broadly supportive of the proposed scheme Published response document on 14 December, which confirmed: Ofwat will use statutory transition scheme to revoke WSLs and confirm compensation shall be nil; and Defra will address the issue of existing section 66D agreements in its 8th Commencement Order http://www.ofwat.gov.uk/publication/statutory-transition-scheme-for-retail-market-opening-response-document/

Programme update on wider transition arrangements We plan to publish a further Programme Update in January to provide an update on the wider transition issues, including: Confirming a 30 working day ‘freeze’ on processing WSL customer switches under the Customer Transfer Protocol (CTP); and Arrangements for the signing the MAC framework agreement – planned for Monday 6 March to align with SoS process Note: we propose to implement the freeze on CTP switching ahead of market opening by confirming that Ofwat will not view any refusal to process a switch to a WSL during that short, defined period as a breach of licence obligations. It will not affect the separate preparations for possible Day One switching by WSSLs under the new framework.

Recent progress in the Defra programme Assurance pro-forma letter 3, amended advice and updated FAQ published 9 December – also see notes in this MOSL email Exits decisions published 12 December – 3 weeks ahead of schedule. See our programme note for further info. 5th meeting of the Assurance Group on 12 December – agreed to meet again end Jan to consider final advice. Assurance phase 3 – ‘that’ recap again Letter 3 is all about readiness for market opening Remember this has been a framework of continuous assurance – there shouldn’t be any surprises by this stage Key dates MP letter: 3 Feb MOSL letter: 10 Feb Ofwat letter: 10 Feb Defra letter: 17 Feb Requires confirmation that work plans are materially completed (or will be completed) for market opening New entrant retailers and associate licensees (i.e. market participants who will be operating under a WSSL) are required to submit a letter at phase 3 20

Retailers and new entrants may have to re-type their names in some places. Please check you have completed all relevant sections. 22

Background A number of options were discussed for dealing with large numbers of switches which may be initiated at market opening (October & November WRG). At the WRG meeting in November, MOSL outlined the Programme’s preference for Option 2, as below: While there was reasonable consensus for option 2, a number of potential issues and implications were raised by WRG members and a further opportunity to comment given Option 2 Transfer Registration Applications to commence between 6 and 20 days ahead of day 1, enabling the Registration Start Date of the transfer to be day 1

Transfer registration applications not allowed Reminder - option 2 Transfer Registration Applications will be processed to enable Registration Start Date on Day 1 (i.e. 1 April 2017) Day 1 Retail Exit RSD Deadline to exercise customer choice as part of Retail Exit 01/04/2017 30/03/2017 23/03/2017 6BDs before RSD Last day to submit transfer applications for Day 1 RSD 06/03/2017 20BDs before Registration Start Date (RSD) First day to submit transfer applications for Day 1 RSD Time interval allowed for Day 1 switching Transfer registration applications not allowed Transfer applications up to 2 days before Day 1 due to customer choice in an area which is subject to Retail Exit will be transferred with the RSD of the Retail Exit i.e. Day 1 (to avoid double switching)

Some considerations A huge majority of SPIDS will be subject to an exit: c70% to an associate c25% to a 3rd party c5% not subject to exit Retail exits are governed by separate process designed to achieve exit with effect from Day 1 with option for customers to opt out Switching under the market codes allows for cancellation by an outgoing retailer for debt. This risk is assumed priced in at retail exit Competitive activity is already taking place

Responses 13 further responses received: 4 prefer Option 1 1 didn’t express a preference Overall balance in favour of Option 2 Useful detailed questions and concerns were helpful Programme partners have considered the responses and the issues raised RMOMG determined at its meeting 19 December that Option 2 remains preferred approach. The programme will look at ways of mitigating risks raised

Key themes from responses Need detailed guidance to understand the approach and impact Interlinking between retail exit options and early switching Protection for customers ahead of go-live against poor behaviour by retailers or risk of error Protections for market participants ahead of go-live; e.g. will cancellation be an option and enforceable? Impact on customers experience and perceptions of the market if there is double-switching Interaction with other processes needed for market opening: go-live decision, contract signing, need to post credit, etc
