Enterprise Agreements

Collective Agreement There are now 4 Neighbourhood Houses & Adult Education Centres Agreements -2007/2008/2010/2016 The Conditions of each of these collective Agreements remains in force until terminated by Fair Work or replaced. The Current Agreements rely on the relevant Awards for increases in wages. Pay rates must match modern award (MA) rates and in the case of SCHCADS must include the MA plus ERO rates.

What changes are there? Key changes from the 2010 include: Changes to TOIL and Flex to clearly articulate the difference: TOIL is at Employers request Flex is at Employees request Also clarifies TOIL is paid on termination Attendance at Committee meetings – now 4 meetings per 28 days. Increase in bereavement leave to 5 days paid. Annual Leave may be used as single days. Superannuation paid for all employees –including those earning less than $450 per month

What changes are there? Family Violence Leave – new clause inserted provides for 10 days paid leave access. LSL – allows employees access to LSL pro-rata after 7 years of service (no change to portability). Casual conversion after 12 months where role is continuing. Increase to paid parental leave for scheduled as following: 12 weeks phased in year 1= 8 weeks, year 2=10 weeks, year 3= 12 weeks (ESPSE employees remains at 12 weeks). Wages of 3% for all employees each year of the Agreement, ERO also applies to SCHCADS classified Employees in December each year of the Agreement. Increase to allowances

Agreement now in place Those houses who are respondent to the Agreement should now be following the terms and conditions of the new Collective Agreement. Houses that did not sign on to the new Agreement will continue to uphold the conditions of their existing EBA or Award conditions of employment (including rates of pay). Ensure you follow the correct applicable pay table for your Organisation Generally 1 increase each year for all employees plus incremental increase if applicable For SCHCADS classified employees there is an additional December increase.

Organisations covered by previous Agreements. For organisations not on the 2016 agreement the old agreements (2007/2008 and 2010 Agreement conditions prevail). Pay rates must match modern award (MA) rates and in the case of SCHCADS must include the MA plus ERO rates.

Organisations covered by Awards. Award covered Organisation must follow the conditions of the modern Award. The pay rates are soon to be increased in line with the National Minimum Wage increase – Jobs Australia will publish pay tables as soon as they are available.

Modern Award Review For Organisation covered by Award: Awards are currently undergoing review and we may see variations to the Award happening in the latter half of 2017. Jobs Australia will advise any variations to the Award as they occur.
