New Rock Lobster Taskforce Approach Specific team with a focus on commercial rock lobster fishery quota declaration compliance. Role: Increased focus on integrity of catch declarations. Team analyses data regularly and identifies patrol areas (top outliers in data sweeps). “Target information” is provided to the appropriate District Office from Bunbury to Geraldton. Team offers field support to District offices for the “target areas”. Utilising Fisheye, EMU data, IVR and Qlikview.

Rock Lobster Taskforce In its initial 12 months the team attended to: 183 Administrative Offences 19 Over quota Offences (2015 season) Made investigative contact with 74 Authorisation holders over administrative matters 467 Contacts registered by field patrols 236 gear inspections (Whale Mitigation gear) – 8 warnings for 2016 Season to date 32 Vessel searches 30 Personal bag searches Inspection of 33 Landing zones north of Metro Areas and inspection of all major receival depots and processing locations. .

Compliance Focus - Targeted Independent weight verifications. Master to Truck independent weight compliance.                Weighing Process Open and transparent according to Cl.43. Receiver weight compliance, independent and not mirrored off truck or master. Correct nominations before moving vessel, before entering landing area and immediate after consigning. Consigning and documentation including A Zone requirements (Holding, Carrier vessel).

Over quota

New Approach to Deal with Over-Quota Issuing a Notice Requiring Payment of Proceeds. Cl 19A An approach to negate any financial benefit from the catch landed above quota. Notice to either licence holder or person acting on behalf of (Master). Amount determined by DOF on the day market price (per KG). Payment to Fisheries Research and Development Account (FRDA). Payment to be made within 14 days. Licence suspended after 5 days of issue if failure to pay. Can be applied for any over-quota amount, ie. >0.1kg. Cl 19B - Review of CEO notice by SAT for determination under 19A(2)

New Approach to Deal with Over-Quota Clause 20 defence Will remain available for ≤ 30 kg - Within 21 days of the catch exceedance. Payment of the prescribed value. Only available if no contravention of Cl19 in previous 12 months. Not available where exceedance is considered reckless or intentional (Section 74.1 offence).

Black market Big fines for interfering with rock lobster fishing gear ​Two men have been ordered to pay a total of more than $87,700 for a range of joint and individual fishing offences. A Joondalup Court heard the men had been under surveillance by Fisheries and Marine Officers on 23 December 2013 and again on a number of days in November and December last year; before they were apprehended, interviewed and later charged. A Greenwood man was fined $14,000 and issued with an additional mandatory penalty of $46,250 and court costs of $169.10. A Kallaroo man was fined $14,000, given an additional mandatory penalty of $13,200 and $169.10 in court costs. Among their offences, they faced 11 joint charges of interfering with fishing gear that did not belong to either of the accused. The magistrate also ordered forfeiture of the boat and trailer used to commit the joint offences, along with the 298 rock lobster tails, 24 whole western rock lobsters and six lobster pots, which had also been seized by Fisheries and Marine officers.

And further…. A Kalbarri man appeared in the Geraldton Magistrates Court on the 22 October 2015. Convicted of using more than two rock lobster pots x 4 Unlawfully selling rock lobster x 2 Unlawfully selling mackerel x 1 Fined $14,000 Court costs $670 Cancelled recreational fishing licence for 6 months. Subject to further administrative law provisions regarding “fit and proper”
