What is Fair Housing? Fair housing is the right to choose housing free from unlawful discrimination.  Federal, state and local fair housing laws protect people from discrimination in housing transactions such as rentals, sales, lending, and insurance and other factors. Fair housing is the key to all people having the right to choose where they live. It guarantees that regardless of your age, race, religion, family situation, or level of ability, you have the right to choose the housing that’s best for your need

What and Why Are We Doing and Assessment of Fair Housing (AFH) + Its Purpose? Primary Purpose of AFFH Final Rule is to: Define a planning process to address fair housing Clarify fair housing obligations Provide open data and mapping tools to localities Offer a “balanced approach” to fair housing Facilitate fair housing local decision-making goals and priorities Encourage collaboration on fair housing assessments Facilitate community participation in local process Originally established in 1968 to direct HUD and funding recipients to promote fair housing and equal opportunity. On July 16, 2015 - HUD published a revised final AFFH rule The AFFH process means taking steps to proactively address significant disparities in access to opportunity, by identifying the root causes that limit housing and neighborhood choice – “Contributing Factors” – and to develop goals and strategies to overcome them. In other words, HUD grantees must do more than focus on housing discrimination.

Implementing the AFFH Through the New Assessment of Fair Housing (AFH) Tool -Replaces the previous Analysis of Impediments to Fair Housing Choice (AI) -Provides a standardized framework for program participants -Requires the use of local data & knowledge, and HUD-provided maps and tables -To inform and integrate fair housing strategies , ConPlans, PHA Plans, and other local plans -AFH submission mandate – every five years in advance of new ConPlan or PHA Plan and must be accepted by HUD Fair Housing Issues to be Addressed -Patterns of integration and segregation -Racially and ethnically concentrated areas of poverty (R/ECAPs) -Disparities in access to opportunity -Disproportionate housing needs
