Fair Housing PSA (English)

Fair Housing PSA (Spanish)

What is Fair Housing? Fair housing is the right to choose housing free from unlawful discrimination.  Federal, state and local fair housing laws protect people from discrimination in housing transactions such as rentals, sales, lending, and insurance and other factors. Fair housing is the key to all people having the right to choose where they live. It guarantees that regardless of your age, race, religion, family situation, or level of ability, you have the right to choose the housing that’s best for your need

Who is Protected Under Federal Fair Housing Law? Federal Fair Housing Act (FHA) Title VIII of the Civil Rights Act 1968 Sex Gender Sexual harassment Disability (Mental and/or Physical) Reasonable Accommodation: Changes to Policies Reasonable Modification: Structural Changes On February 3, 2012 – HUD issued a final rule on equal housing in HUD programs regardless of sexual orientation, gender identify, and marital status. Race Color Religion National Origin Familial Status Families with children

Who is Protected Under Fair Housing Laws in California? California Department of Fair Employment and Housing Act 1964 (FEHA) Marital Status (e.g. singles, married) Ancestry Sexual Orientation Gender Identity Gender Expression Genetic Information Income Source Other California Laws Age Immigration Status Freedom from Violence or Intimidation

Additional Protected Classes In the City of Los Angles? Physical Disability (HIV & AIDS included Familial Status (Children) Student Status Arbitrary Reasons

Examples of Prohibited Practices Refusal to sell or rent housing Saying that housing is unavailable when it actually is available Applying different terms or rules Refusal to grant a reasonable accommodation and/or modification for a person with a disability. Discrimination based on association Threats, intimidation, harassment, coercion Steering Discriminatory statements or advertising

What and Why Are We Doing and Assessment of Fair Housing (AFH) + Its Purpose? Primary Purpose of AFFH Final Rule is to: Define a planning process to address fair housing Clarify fair housing obligations Provide open data and mapping tools to localities Offer a “balanced approach” to fair housing Facilitate fair housing local decision-making goals and priorities Encourage collaboration on fair housing assessments Facilitate community participation in local process Originally established in 1968 to direct HUD and funding recipients to promote fair housing and equal opportunity. On July 16, 2015 - HUD published a revised final AFFH rule The AFFH process means taking steps to proactively address significant disparities in access to opportunity, by identifying the root causes that limit housing and neighborhood choice – “Contributing Factors” – and to develop goals and strategies to overcome them. In other words, HUD grantees must do more than focus on housing discrimination.

Expected AFFH/AFH Outcomes Integrated living patterns Overcoming historic patterns of segregation Transforming racially and ethnically concentrated areas of poverty into areas with greater access to opportunity Reducing disparities in access for different protected classes Responding to disproportionate housing needs of different protected classes

Implementing the AFFH Through the New Assessment of Fair Housing (AFH) Tool -Replaces the previous Analysis of Impediments to Fair Housing Choice (AI) -Provides a standardized framework for program participants -Requires the use of local data & knowledge, and HUD-provided maps and tables -To inform and integrate fair housing strategies , ConPlans, PHA Plans, and other local plans -AFH submission mandate – every five years in advance of new ConPlan or PHA Plan and must be accepted by HUD Fair Housing Issues to be Addressed -Patterns of integration and segregation -Racially and ethnically concentrated areas of poverty (R/ECAPs) -Disparities in access to opportunity -Disproportionate housing needs

AFH Required Components Demographic Summary Analysis of Segregation Analysis of R/ECAPs Analysis of Disparities in Access to Opportunity* Analysis of Disproportionate Need Analysis of Disability & Access Fair Housing Enforcement, Outreach Capacity & Resources Analysis Measures of Segregation Analyzing Indicators of Access to Opportunity Dissimilarity Index Low Poverty Index School Proficiency Index Jobs Proximity Index Labor Market Index Low Transportation Cost Index Transit Trips Index Environmental Health Index
