Why does lorry security matter? Cost – NAO estimates each asylum application could cost the UK up to £25k Border Security risk - unknown individuals able to enter the UK Fuels criminality - Illegal working and use of false identities; and undercut legitimate competition and employment Load destruction and transport disruption – High costs to industry as a result of migrant activity

Clandestine civil penalty consultation Clandestine civil penalty – driver and owner of unsecured vehicles may be charged up to £2,000 per clandestine entrant. Too many lorries do not meet our security expectations The Home Office consulted on high-level proposals to strengthen the civil penalty regime earlier this year: Modernising the ‘prevention of clandestine entrants’ code of practice to take account of sector best practice – keeping the same structure; Revising the level of penalty code of practice to review the methodology and to ensure greater transparency in the charging framework; Ensuring the civil penalty regime overall incentivises operators to invest in high quality security measures.

Information sharing Information – sharing agreements which will enable us to pass the details of non-compliant hauliers to haulage regulators in the UK and Europe are being finalised. Regulators have a duty to ensure hauliers are of ‘good financial standing’ and ‘ good repute’. Those that do not comply with the civil penalty scheme may not meet these requirements. It is in all our interests to ensure that non-compliance is addressed.

Support The civil penalty regime does not operate in isolation. The Government continues to work closely with industry: Raising awareness of vehicle security requirements Publish guidance, checklists and lorry security/safety posters Upcoming poster campaign Work with European haulage associations to spread good practice Support the sector with best practice Regular engagement between Border Force and trade bodies Translation of documents into key European languages How can we work with other sectors, and the road authorities, to influence lorry security?

Companies can join an accreditation scheme. Companies can apply to join the Civil Penalties Accreditation Scheme. It is free to apply! Systems will be assessed based on the information you provide; which may include a visit your company. We’ll review your accreditation on a regular basis. Companies in the scheme must continue to meet all the requirements to avoid being fined. Since July 2015 we have published the list of accredited hauliers. Eligibility The scheme is open to road haulage companies of any size or nationality operating between Continental Europe and the United Kingdom. A company must be able to show that it: has an effective system for preventing clandestine entrants (this is described in the prevention of clandestine entrants code of practice) takes reasonable measures to make sure that the system works, e.g. training and monitoring its drivers
