DEFINITIONS JUVENILE OFFENDER JUVENILE DELINQUENT PINS (PERSON IN NEED OF SUPERVISION) DESIGNATED FELONY INTAKE DIVERSION

JUVENILE OFFENDER PENAL LAW SECTION 10.00 18 (1) A PERSON THIRTEEN YEARS OLD WHO IS CRIMINALLY RESPONSIBLE FOR ACTS CONSTITUTING MURDER IN THE SECOND DEGREE AS DEFINED IN SUBDIVISIONS ONE AND TWO OF SECTION 125.25 OF THIS CHAPTER OR SUCH CONDUCT AS A SEXUALLY MOTIVATED FELONY, WHERE AUTHORIZED PURSUANT TO SECTION 130.91 OF THE PENAL LAW; AND

JUVENILE OFFENDER CONT. 18 (2) A PERSON FOURTEEN OR FIFTEEN YEARS OLD WHO IS CRIMINALLY RESPONSIBLE FOR ACTS CONSTITUTING THE CRIMES DEFINED IN SUBDIVISIONS ONE AND TWO OF SECTION 125.25 (MURDER IN THE SECOND DEGREE) AND IN SUBDIVISION THREE OF SUCH SECTION PROVIDED THAT THE UNDERLYING CRIME FOR THE MURDER CHARGE IS ONE FOR WHICH SUCH PERSON IS CRIMINALLY RESPONSIBLE; SECTION 135.25 (KIDNAPPING IN THE FIRST DEGREE); 150.20 (ARSON IN THE FIRST DEGREE); SUBDIVISION ONE AND TWO OF SECTION 120.10 (ASSAULT IN THE FIRST DEGREE); 125.20 (MANSLAUGHTER IN THE FIRST DEGREE); SUBDIVISIONS ONE AND TWO OF SECTION 130.35 (RAPE IN THE FIRST DEGREE); SUBDIVISIONS ONE AND TWO OF SECTION 130.50 (CRIMINAL SEXUAL ACT IN THE FIRST DEGREE); 130.70 (AGGRAVATED SEXUAL ABUSE IN THE FIRST DEGREE); 140.30 (BURGALRY IN THE FIRST DEGREE); SUBDIVISION ONE OF SECTION 140.25 (BURGLARY IN THE SECOND DEGREE); 150.15 (ARSON IN THE SECOND DEGREE); 1460.15 (ROBBERY IN THE FIRST DEGREE); SUBDIVISION TWO OF SECTION 160.10 (ROBBERY IN THE SECOND DEGREE) OF THIS CHAPTER; ORSECTION 265.03 OF THIS CHAPTER, WHERE SUCH MACHINE GUN OR SUCH FIREARM IS POSSESSED ON SCHOOL GROUNDS, AS THAT PHRASE IS DEFINED IN SUBDIVISION FOURTEEN OF SECTION 220.00 OF THIS CHAPTER; OR DEFINED IN THIS CHAPTER AS AN ATTEMPT TO COMMIT MURDER IN THE SECOND DEGREE OR KIDNAPPING IN THE FIRST DEGREE, OR SUCH CONDUCT AS A SEXUALLY MOTIVATED FELONY, WHERE AUTHORIZED PURSUANT TO SECTION 130.91 OF THE PENAL LAW.

JUVENILE DELINQUENT A PERSON OVER SEVEN (7) YEARS OF AGE AND LESS THAN SIXTEEN (16) YEARS OF AGE WHO COMMITS AN ACT THAT WOULD CONSTITUTE A CRIME (MISDEMEANOR OR FELONY) IF COMMITTEDBY AN ADULT, EXCEPT AS DEFINED IN JUVENILE OFFENDER DEFINITION. ACTIONS AGAINST JUVENILE DELINQUENTS ARE PROSECUTED IN FAMILY COURT BY THE COUNTY ATTORNEY.

PINS PERSON IN NEED OF SUPERVISION NOW REFERRED TO AS A JUVENILE JUSTICE. A CHILD UNDER THE AGE OF 18 WHO IS HABITUALLY TRUANT FROM SCHOOL AND/OR UNCONTROLLABLE AT HOME/SCHOOL/COMMUNITY. COMMON BEHAVIORS INCLUDE RUNAWAY BEHAVOIR, SERIOUS PATTERN OF DISOBEDIENCE, PHYSICAL/VERBAL ABUSE OF PARENTS, TRUANCY.

DESIGNATED FELONY AN ACT WHICH IF DONE BY AN ADULT WOULD BE A CRIME AS DEFINED IN THE FAMILY COURT ACT SECTION 301.2 (8) AND VARIOUSLY AFFECTING PERSONS 13, 14 OR 15 YEARS OF AGE. SINCE THESE PERSONS ARE ALSO JUVENILE DELINQUENTS ACTIONS INVOLVING A DESIGNATED FELONY ARE HANDLED BY THE COUNTY ATTORNEY.

INTAKE THE PROCESS OF COMMENCING AN ACTION AGAINST A JUVENILE DELINQUENT. THIS FUNCTION IS PERFORMED BY THE PROBATION DEPARTMENT ACTING ON A PETITION PREPARED BY THE COUNTY ATTORNEYS OFFICE AT THE REQUEST OF THE POLICE DEPARTMENT OR IN SOME CASES AT THE REQUEST OF A PARENT OR GUARDIAN AS THE COMPLAINANT. INTAKE MAY INVOLVE ADJUSTMENT OF THE CASE BY THE PROBATION DEPARTMENT OR REFERRAL TO THE FAMILY COURT.

DIVERSION ANY LESSER ALTERNATIVE AFFORDED A JUVENILE WHICH IS SUBSTITUTED FOR ONE WHICH MIGHT BE IMOSED WITHIN THE JUVENILE JUSTICE SYSTEM.

WHAT IS FINGERPRINTABLE?? 11 OR 12 YEARS OF AGE AND COMMITS CLASS A OR B FELONY 13, 14 OR 15 YEARS OF AGE AND COMMITS ANY FELONY.
