2011 Mining Workshop Series Strategies to Address Mining in the EAA Consensus Building Workshop #1 – January 5, 2011 Departmental Presentation by: Planning, Zoning & Building Environmental Resources Management

How did we get here? PBC Planning Division Isaac Hoyos COMMISIONERS YOU MAY RECALL AT A MINING ZONING HEARING IN 2009 AT WHICH A MINING APPLICATION WAS BEING CONSIDEREDTHE BOARD DISCUSSED WITH EXECUTIVES FROM SFWMD THE POTENTIAL IMPACTS OF MINING ACTIVITIES ON EVERGLADES RESTORATION PROJECTS. THE BCC DIRECTED STAFF TO WORK WITH SFWMD TO REVIEW POLICIES IN THE PLAN WHERE THESE CONCERNS COULD BE ADDRESSED. SUBSEQUENTLY, IN NOVEMBER OF LAST YEAR THE BOARD INITIATED AN AMENDMENT IN ROUND 10-1 TO LOOK AT POLICIES IN THE PLAN. STAFF FROM BOTH AGENCIES LOOKED AT PLAN’S POLICIES AND DECIDED TO FOCUS ON THREE AREAS OF THE PLAN, MINING, THE GLADES TIER AND INTERGOVERNMENTAL COORDINATION. EXPLAIN THE ABOVE AFTER AN INITIAL DRAFT, THE AMENDMENT WAS WITHDRAWN BY STAFF BEFORE THE LPA HEARING FOR FURTHER REVIEW. IN APRIL OF THIS YEAR STAFF PRESENTED THE ITEM AGAIN FOR BOARD INITIATION IN THE CURRENT ROUND OF AMENDENTS.

Background The Glades region in PBC is a key component of the Everglades Ecosystem. Includes 3 Cities and settlements around Lake Okeechobee A vast area dedicated to agriculture and other activities THE GOAL OF THIS AMENDMENT IS TO AFFORD THE BOARD MORE INFORMATION AND DISCRETION WHEN REVIEWING COMMERCIAL MINING APPLICATIONS STAFF HAS LOOKED AT DIFFERENT OPTIONS THAT I WILL DESCRIBE IN A MOMENT…

The Glades Region MOST OF THE COMMERCIAL MINES IN THE COUNTY HAVE BEEN APPROVED WITHIN THE EVERGLADES AGRICULTURAL AREA (EAA). FL DEPT OF TRANSPORTATION AGGREGATE STUDY SHOWNS EAA AS A PRIME AREA FOR ROCK MINING. IT IS ALSO A PRIME AREA FOR AGRICULTURE AND RELATED USES. AND IS THE FOCUS OF EVERGLADES RESTORATION EFFORTS. FOR NEARLY 2 DECADES ONLY TWO MAJOR MINES WERE APPROVED AND HAVE BEEN OPERATING IN THIS REGION. THOSE MINES SHOWN IN GREEN ARE STAR RANCH/BERGERON IN THE CENTER OF THE EAA AND PALM BEACH AGGREGATES IN THE EASTERN-MOST PORTION OF THE EAA BY 20-MILE BEND. THE REST OF THE LARGE MINES SHOWN IN ORANGE HAVE BEEN PROCESSED DURING THE LAST 3-4 YEARS FOR A TOTAL OF 25,000 ACRES IN APPROVED MINES. SOME ADJACENT OR WITHIN CLOSE PROXIMITY TO LARGE RESTORATION PROJECTS. THIS MAP ILLUSTRATES THE POTENTIAL FOR IMPACTS BETWEEN MINES AND RESTORATION EFFORTS THE BCC HAS BEEN CONCERNED WITH SINCE 2009 WHEN THE BOARD GAVE DIRECTION TO STAFF TO START LOOKING INTO THIS ISSUE.

Background From the land use perspective: The urban area around cities governed by an assortment of urban land uses The agricultural area is governed by the Agricultural Production (AP) land use/zoning AP allows for other uses like institutional, public facilities, regional water management facilities and rock mining and other excavations THE GOAL OF THIS AMENDMENT IS TO AFFORD THE BOARD MORE INFORMATION AND DISCRETION WHEN REVIEWING COMMERCIAL MINING APPLICATIONS STAFF HAS LOOKED AT DIFFERENT OPTIONS THAT I WILL DESCRIBE IN A MOMENT…

Glades Rock Mining History Before 2006 and for over two decades three mines were approved in this region. CLOSE TO 1700 ACRES HAVE BEEN MINED TO DATE - OUT OF NEAR 25,000 ACRES APPROVED BY THE COUNTY. THE BALANCE OF MINES WITH ZONING APPROVALS BY THE COUNTY ARE STILL PROCESSING STATE AND FEDERAL PERMITS. WHEN OPERATIONAL THESE APPROVALS COULD LAST UP TO 73 YEARS MORE IN OPERATION

Board Concerns Since 2006 concerns have been expressed about the limited discretion the mining approval process affords the Board The BCC has discussed and taken action on alternatives to improve mining review process Bullet 1: SOME BCC MEMBERS HAVE EXPRESSED FRUSTRATION WITH THE LIMITED DISCRETION AFFORDED TO THE BOARD BY THE EXISTING PERMITTING PROCESS FOR MINES Bullet 2: THERE HAVE BEEN CONCERNS ABOUT THE LARGE ACREAGE OF MINES APPROVED (25,000 ACRES) WITH ONLY TWO IN ACTUALOPERATIONS (1700 ACRES TO DATE). ARE THESE APPROVALS ENOUGH? Bullet 3: AS INDICATED IN PREVIOUS SLIDE TO RESPOND TO THESE AND OTHER CONCERNS A TEXT AMENDMENT WAS INITIATED BY THE BCC TO EXPLORE ALTERNATIVE OPTIONS Bullet 4: THE BCC ALSO INITIATED A 1-YEAR MORATORIUM ORDINANCE, TO BE HEARD ON FIRST READING TOMORROW, TO ALLOW FOR REVISIONS TO THE PLAN AND THE CODE ADDRESSING BCC CONCERNS.

BCC actions on Mining 2008 Strategic Aggregates Review Task Force participation 2008 Organization of a Regional Mining Summit 2009 Completion of Permit Review Study Recommendations to adjust local permitting process have been implemented as result of the study. Options discussed included: Continuation of current process Amendments to the Comp Plan Amendments to the ULDC Limiting mines to certain areas of the EAA A Moratorium on commercial rock mining Bullet 1: SOME BCC MEMBERS HAVE EXPRESSED FRUSTRATION WITH THE LIMITED DISCRETION AFFORDED TO THE BOARD BY THE EXISTING PERMITTING PROCESS FOR MINES Bullet 2: THERE HAVE BEEN CONCERNS ABOUT THE LARGE ACREAGE OF MINES APPROVED (25,000 ACRES) WITH ONLY TWO IN ACTUALOPERATIONS (1700 ACRES TO DATE). ARE THESE APPROVALS ENOUGH? Other 2010 Activities June 22 - Stakeholder Workshop July 21 – Transmittal hearing of proposed land use amendments Proposed text amendments WERE NOT transmitted August 26 – The Board took action on: Adoption of One (1) year Moratorium on Rock Mining Directed Staff seek University-affiliated facilitator to address mining concerns and recommend alternative solutions STAFF EXPLORED SEVERAL ALTERNATIVE OPTIONS TO ACHIEVE THE GOAL OF THIS AMENDMENT: STAFF’S RECOMMENDATION IS TO REQUIRE THE CREATION OF A ZONING DISTRICT IN THE COMP PLAN THAT ONCE ADOPTED WILL BE IMPLEMETED IN THE CODE. THEREBY REQUIRING ADDITIONAL CRITERIA TO BE CONSIDRED BY THE BOARD THAT ALLOWS FOR A MORE INFORMED DECISION-MAKING TOOL ATT HE LOCAL LEVEL. ALTERNATIVE ONE IS AN AMENDMENT TO A MINING LAND USE THAT WILL GIVE THE BCC THE MOST LEGISLATIVE DISCRETION BUT COULD LEAD TO POTENTIAL PROPERTY RIGHTS LITIGATION AND LOST OF LOCAL LEVEL DECISION-MAKING. THE LAST ALTERNATIVE IS TO RETAIN EXISTING REGULATIONS, WHICH LIMITS THE DISCRETION THE BOARD HAS BEEN LOOKING FOR.

Excavation Pre-Application Checklist The applicant shall secure the information described on the excavation pre-application checklist and shall use this information as the basis for a pre-application meeting with DEP. This application information and meeting is necessary to obtain a Preliminary Assessment Letter (PAL) from the DEP, Bureau of Mines and Minerals.

Final Approvals Preliminary data is needed prior to final site plan approval to excavate deeper than 15 feet within the WCAA. Total Chlorides are not to exceed 250 ppm.

Zoning and ULDC Requirements PBC Zoning Division Carrie Rechenmacher

ULDC Requirements Class A Conditional Use (CA) for a Type III A or B excavation (commercial mining excavation that includes blasting). Standard Application Requirements such as a site plan, indicating phasing, separation and setbacks, application forms, and justification. PAL - Letter required as part of initial application

Conditional Use Standards: Consistency with the Plan Consistency with the Code Compatibility with Surrounding Uses Design Minimizes Adverse Impact Design Minimizes Environmental Impact Development Patterns Consistency with Neighborhood Plans Adequate Public Facilities (Concurrency) Changed Conditions and Circumstances

Agency Coordination prior to certification for public hearing The PAL letter indicating the request will not have a significant adverse impact to water quality or the overall health of available water resources. The letter is forwarded to the Water Control or Management District who may provide comments to the DRO to be included in the staff report prior to the BCC hearing. DRO certification requiring initial sign off from County Agencies - Health, ERM, Land Development, Survey, Fire, County Attorney, Traffic, Planning, etc.

Final Approvals and ongoing monitoring Reclamation plan: Final “as built” plan Bonds for upland and upland planting (zoning), littoral and excavation area (ERM). Annual Report to monitor the intent of the BCC conditions. BCC Conditions of Approval provide further monitoring of mine status.

ULDC Amendments Ordinance 2006-004: Littoral Zone of 8 SF per 1 FT of Shoreline. Zoning Ordinance 2008-037 require compliance with a DEP Bureau of Mines and Minerals pre- application checklist before intake of any mining operation. (PAL) ERM extraction Fee of $.05 per ton of material extracted Additional monitoring regulations
