Difference between Trademark and Copyright Infringement? Both intellectual property protection, they protect different types of assets. Copyright is geared toward literary and artistic works, such as books and videos. Trademark protects items that help define a company brand, such as its logo. What is Copyright Infringement? Use of works protected by copyright law Without permission Infringing exclusive rights to copyright holder Right to reproduce and distribute Display or perform the protected work To make derivative works

Section 107, fair use not Infringement: Purpose of character usage: ► commercial, educational, transformative, or reproductive Nature of Copyright work: ► fictional, factual, degree of creativity Amount and substantiality original work used Effect on market or potential market

Trademark Conflicts? Trademarks and domain names always come head to head? Trademark governed by regional, governmental agencies, geography and culture Domain governed by administrative agencies around the world Global registry would be almost impossible Disputes between trademark holders and domain name registrants will continue to occur.

Can HRTC use trademark “H” with broken circle? H trade-mark company abandoned “H” logo Filed status 2015-08-14-2017-02-13 Many similar “H” trademarks from “Google” and “TESS” Yes, HRTC can use mark Concern for possible confusion? If use mark, people relate to gun shop?
