Nonconforming Lots and Minimum Lot Sizes Presentation to the Planning Board November 15, 2016

Issues Being Addressed 1960’s suburban zoning. Nonconformance deficiency revealed by Thirlmere case. Nonconformance deficiencies revealed by experience. AA and A minimum lot sizes out of character with older neighborhoods. Lack of fairness between owners of NCLRs and owners of conforming lots with the same amount of land.

Nonconforming Lots of Record Standards Planning Board review in all cases. Neighborhood compatibility standards. Stormwater runoff (applies to all single-family permit applications). Relation to street. Building width. Roof style and orientation. Building height and style (maximum 28 feet). Front façade. Exterior materials. 25% landscaped vegetated and permeable (except for naturally impermeable) open space.

NCLR Standards (cont.) No basements in combined sewer areas. Minimum 12’ separation from all buildings on abutting lots. Minimum 35’ street frontage except if the Planning Board finds that the average lot width of neighboring developed single-family lots is less than 35’ or if the owner does not have abutting land available to increase the frontage to at least 35’. No moving lot lines. No building or parking easements. Can only be used for a single-family detached dwelling. Maximum 28’ height limit. Maximum building coverage of 25% of the lot.

NCLR Standards (cont.) Must conform with the space & bulk regs of the zoning district, except for minimum lot area, minimum street frontage, and maximum net residential density. Must be connected to public sewer. Must include a stormwater runoff drainage plan approved by the City’s engineer. Must comply with Shoreland Zoning if applicable. Must comply with Flood Hazard regulations, if applicable.

Comprehensive Plan – Min. Lot Size Most new single-family residential development in South Portland’s Intown and Main Street areas has been on existing lots of 10,000 SF or less, which in many cases would be considered nonconforming if the lots did not already exist. The City should consider altering lot size and other dimensional requirements in these areas. The City’s established residential neighborhoods are one of its major assets. These neighborhoods offer a range of residential environments and housing styles. Currently the City’s zoning regulations make many of the lots and homes in these neighborhoods nonconforming with respect to lot sizes and setbacks due to outdated requirements.

Comprehensive Plan – NCLRs 1. The City’s land use regulations should allow the construction of infill housing in established residential neighborhoods at a density that is similar to the established pattern of the neighborhood as long as the new housing is compatible with the character of the neighborhood. 2. Enhance the livability and walkability of the City’s established neighborhoods while allowing infill development that is in character with these neighborhoods – South Portland’s established residential neighborhoods are its soul and a major reason people choose to live in the City. Assuring that these neighborhoods remain desirable places to live is a fundamental objective of this Plan. At the same time, limited development/redevelopment should be encouraged within these neighborhoods as long as it is compatible with the character of the individual neighborhood in which it is located.
