Session Overview Structure and Organization of the Regulations Organization of Part 463 Highlights of Part 463 subpart A Part 463 subpart D [first four rules]

Structure and Organization of the Regulations Title 34 of the Code of Federal Regulations (CFR) contains regulations pertinent to ED. Parts 462 and 463 pertain specifically to AEFLA. Parts are organized into subparts (denoted by capital letters) and then into sections (e.g., §463.1). Part 462 addresses NRS assessment for WIOA performance accountability reporting. Part 463 addresses WIOA requirements particular to AEFLA including joint regulations.

Part 463 Subpart D Contains 9 Rules Adult education and literacy programs, activities, and services (463.30) English language acquisition (ELA) program (463.31) Meeting the requirement that the ELA program lead to attainment of a secondary school diploma or its recognized equivalent and transition to postsecondary education and training or leads to employment (463.32) Integrated English literacy and civics education services (463.33)

§463.30 What are adult education and literacy programs, activities and services?

Adult Education and Literacy Programs, Activities and Services include: Workplace adult education and literacy activities, Family literacy activities, English language acquisition activities, Integrated English literacy and civics education, Workforce preparation activities, or Integrated education and training.

What is an English language acquisition program? §463.31 What is an English language acquisition program?

English Language Acquisition Program A program of instruction— (a) That is designed to help eligible individuals who are English language learners achieve competence in reading, writing, speaking, and comprehension of the English language; and (b) That leads to-- (i) (1) Attainment of a secondary school diploma or its recognized equivalent; and (2) Transition to postsecondary education and training; or (ii) Employment.

Preamble Discussion “We do not believe that the statutory requirement that the English language acquisition program must lead to . . . precludes serving eligible individuals whose primary motivation for participating in the program is to support the educational development of their children.”

Preamble Discussion “We believe that it is clear that English language acquisition programs should not discourage or exclude eligible individuals from participation, regardless of whether they are seeking a secondary school diploma or its recognized equivalent, or transition to postsecondary education or training or employment.”

Public Comment: Acronym Fever ELL = English language learner [a type of eligible individual defined in WIOA] ELA = English language acquisition [a particular adult education and literacy activity under WIOA] ESL = English as a Second Language [a set of educational functioning levels used for ELLs]

Preamble Discussion “We agree that States should continue to be able to refer to services in a manner that is most appropriate to the particular circumstances within a State as long as the program or services meet the Act’s definition of English language acquisition.”

§463.32 How does a program that is intended to be an English language acquisition program meet the requirement that the program lead to attainment of a secondary school diploma or its recognized equivalent and transition to postsecondary education and training or leads to employment?

Three Options (a) Have implemented State adult education content standards that are aligned with State- adopted challenging academic content standards, as adopted under the Elementary and Secondary Education Act of 1965, as amended (ESEA) as described in the State’s Unified or Combined State Plan and as evidenced by the use of a State or local curriculum, lesson plans, or instructional materials that are aligned with the State adult education content standards; or

Three Options (cont.) (b) Offer educational and career counseling services that assist an eligible individual to transition to postsecondary education or employment; or (c) Be part of a career pathway.

What are Integrated English Literacy and Civics Education services? §463.33 What are Integrated English Literacy and Civics Education services?

Integrated English Literacy and Civics Education (IELCE) Services (a) Education services provided to English language learners who are adults, including professionals with degrees or credentials in their native countries, that enable such adults to achieve competency in the English language and acquire the basic and more advanced skills needed to function effectively as parents, workers, and citizens in the United States.

Integrated English Literacy and Civics Education (IELCE) Services (cont.) (b) Integrated English literacy and civics education services must include instruction in literacy and English language acquisition and instruction on the rights and responsibilities of citizenship and civic participation and may include workforce training.

Preamble Discussion “Additionally, eligible agencies and eligible providers may want to consider which adult education and literacy activities--e.g., English language acquisition or integrated English literacy and civics education--best meet the needs of particular English language learners and, to the extent possible, match services available to students’ needs.”

Key Concepts The regulations in Parts 462 and 463 do not cover the entire statute. The “that leads to …” requirement for an ELA program applies to the program—not the participants. ELA programs have three options for meeting the requirement. Participants who do not have credential attainment or workforce related goals can still participate. IELCE services include three distinct activities: literacy, ELA, and civics education.
