Who are the Key Players? DHS USCIS ICE CBP U.S. Department of Homeland Security USCIS U.S. Citizenship and Immigration Services ICE Immigration and Customs Enforcement CBP U.S. Customs and Border Protection

Department of Homeland Security Key Agencies Department of Homeland Security U.S. Customs and Border Patrol (inspects people as they enter the United States). U.S. Citizenship and Immigration Services (benefits side of immigration). U.S. Immigration and Customs Enforcement (border patrol, worksite enforcement). Department of State U.S. Consulates (responsible for stamping visas in passports). Department of Labor In H-1B context, employers submit Labor Condition Applications. Handles the PERM process (one available employment based permanent residence option.

Immigration Basics - Terminology Visa: obtained at U.S. Consulate. Without a visa, most foreign nationals cannot enter the United States. Status: the type of category under which a foreign national is allowed to stay in the United States (i.e., B-1, H-1B, F-1, J-1, TN, L-1A, L-1B, LPR, etc.). I-94: card received by non-immigrants as they enter the United States. This card indicates status (i.e., F-1, H-1B, etc.). This card also lets you know how long the foreign national may remain in the United States. New procedures coming from CBP.

Terminology Non-immigrant: foreign national who does not have permanent residence (i.e. does not have a green card). Immigrant: foreign national who has permanent residence. One can be a “green card” holder without having citizenship. Citizen: person who was born in the United States or who naturalized as a U.S. citizen.
