Differences Between Publicity and Electronic Transmission Bylaws 13.10 and 13.02.11

Presence of Media During Recruiting Contact Publicity – Presence of Media During Recruiting Contact An institution may not permit a media entity to be present during any recruiting contact made by an institution’s coaching staff member. Bylaw 13.10.1

Publicity – Comments Before Acceptance An institution may comment publicly only to the extent of confirming its recruitment of the PSA. However… athletics staff members may not evaluate or rate a PSA for news media, or recruiting or scouting services before the PSA’s signed acceptance to attend an institution. Bylaws 13.10, 13.10.2 and 13.10.2.1

Publicity – PSA’s Visit An institution may not publicize (or arrange for publicity of) a PSA’s visit to the institution’s campus. An institution hosting a high school, prep school or two-year college contest may not advertise the appearance of any specific PSAs, nor may it use individual or team photos of participating teams involving PSAs in advertising activities. Bylaws 13.10.4 and 13.10.4.1

Publicity – Photo of PSA An institution may photograph a PSA during a campus visit to be used in the institution’s permissible publicity and promotional activities (e.g., press release, media guide), but the photograph may not be given to the PSA. Bylaw 13.10.6

Publicity – Announcement of Acceptance Once an institution receives the paid acceptance of a written offer of admission and/or financial aid, an institution is permitted to publicize the commitment. Publicity may be released to media outlets (including social media outlets) at the institution’s discretion. Bylaw 13.10.7

Electronic Transmission Any electronically transmitted correspondence may be sent to a PSA (or his/her parents or legal guardians) provided the communication is private between the sender and recipient. That means an institution may not communicate with a PSA via public chat rooms, message boards, or public communication through a social networking site. Bylaw 13.10.7

Electronic Transmission Remember! An enrolled SA may send public correspondence to a PSA if it is not for recruitment purposes. However… an enrolled SA must send private communication if it is for recruitment purposes or at the direction of the athletics department. Bylaw 13.10.7

Athletics Departments and Publicity

Publicity and Social Media Accounts Generally, publicity and electronic transmission legislation apply to the following social media accounts: Institutional athletics accounts; Team accounts; Athletics department staff member’s personal accounts; and SAs’ accounts – when directed by athletics department or staff. Bylaw 13.10

When May an Institution Publicize and/or Communicate Publicly with a PSA? BEFORE financial deposit. AFTER financial deposit but PRIOR TO May 1 of senior year. AFTER financial deposit and AFTER May 1 of senior year. Bylaws 13.10.7 and 13.02.11.4

After Financial Deposit but Before May 1 Athletics may… Send private, direct message to PSA (or PSA’s family) using social media. Use social media to announce PSA’s commitment to attend the institution, without tagging the PSA. Athletics may not… Send public message to PSA (or PSA’s family). Like a PSA’s post (or a post PSA is tagged in). Follow, friend, retweet or tag a PSA.

After Financial Deposit and After May 1 Athletics may… Send private, direct messages to PSA (or PSA’s family) using social media. Send public messages to PSA (or PSA’s family). Use social media to announce PSA’s commitment to attend the institution. Friend, follow, retweet or tag a PSA. Like a PSA’s post (or a post PSA is tagged in).

Case Study 1 Facts: Dunphy Technical University’s (DIII) star pitcher Dede Williams sent this Snapchat to PSA Sydney Barrow; and They met during Sydney’s official visit and decided to stay in touch because Dede would love to have Sydney on the team next year.

Departments Outside Athletics and Publicity

Departments Outside Athletics Recruiting legislation applies to athletics-based recruiting and does not limit an institution’s admissions office from the recruitment of prospective students generally. Therefore… Admissions office (and other departments outside athletics) may publicize a PSA’s visit to the institution’s campus in the same manner done for prospective students generally. Staff member outside athletics may publicly initiate or respond to social media correspondence as long as the staff member… Acts in the same manner for prospective students generally. Does not act at the direction of or on behalf of athletics. Bylaws 13.01.1 and 13.10.4.2 Staff Interpretation April 23, 2015 Official Interpretation December 17, 2015

Case Study 3 (CONT’D) Facts: Phil Dunphy is the current director of athletics at Dunphy Tech (DIII); On December 29, 2016, Phil posted a tweet with a link to a YouTube video featuring in-game highlights of his daughter Hayley; and While the primary focus of the video is Hayley, other PSAs can be seen throughout the video.
