NPDES & PCSM Permitting Workshop What has been added to the Approved list of BMPs and the Alternate BMP approval process NPDES & PCSM Permitting Workshop May 24, 2016

Topics include: Approval process for new BMP consideration ESPC and PCSM BMPs approved after the manuals were approved

§102 11(b) Alternative BMP and design standards. BMPs and design standards other than those listed in the manuals or Buffer Guidance may be used when a person conducting or proposing to conduct an earth disturbance activity demonstrates to the Department that the alternate BMP or design standard minimizes accelerated erosion and sedimentation or manages stormwater during and after the completion of earth disturbance activities to achieve the regulatory standards in subsection (a).

Some products are made in a factory, some BMPs are made on-site with stone, compost, etc.

Dsigner’s Responsibility Burden of proof for whether proposed new product or procedure will be effective lies with designer/manufacturer All necessary information required to evaluate use of new product or procedure to be submitted as part of application Recommended – Format request according to Chapter 12. Do not just send brochures.
