CUP Pet Bazaar Animal Facility with outdoor area

Specific standards. Applicant must make provisions for: 1. Recommendation General conditions. (1) That the use will not materially endanger the public health or safety if located where proposed and developed according to the plan as submitted and approved by the issuance of the C.U.P.; The plan meets the ordinance and long range plans and policies (2) That the use meets all required conditions and specifications; After review by staff the plan has been determined to meet all conditions and specifications (3) That the use will not substantially injure the value of adjoining or abutting property, or that the use is a public necessity; and The proposed use is in keeping with the character of the area and will therefore not injure the value of adjoining properties. (4) That the location and character of the use if developed according to the plan as submitted and approved will be in harmony with the area in which it is to be located and in general conformity with the Town Land Use Plan and Policies The desired Future Land Use of this area includes a continued use as a highway business corridor. Commercial uses shall primarily include retail, office, restaurant, entertainment, and service. Planning & Zoning Commission recommends approval of the CUP located at 1140 N. Lake Park Blvd., Units C, D, E. The Conditional Use Permit with the staff recommendations, a recommend the fence height to be 6' with a 3' screen. The Commission finds that the Conditional Use Permit meets the seven specific standards and four general conditions and conforms to the 2007 Land Use Plan. All in favor (6-0).

Action Staff recommends approval of the conditional use permit and that it meets specific standards and general conditions. Approval must be consistent with the findings in the Zoning Ordinance as follows: (1) That the use will not materially endanger the public health or safety if located where proposed and developed according to the plan as submitted and approved by issuance of the C.U.P. (2) That the use meets all required conditions and specifications; (3) That the use will not substantially injure the value of adjoining or abutting property, or that the use is a public necessity; and (4) That the location and character of the use if developed according to the plan as submitted and approved will be in harmony with the area in which it is to be located and in general conformity with the town Land Use Plan and policies. Denial should be directly related to one or more of the following findings. Reasons for denial must be specifically stated by the Commission: (1) That the use will materially endanger the public health or safety if located where proposed and developed according to the plan as submitted and approved by issuance of the C.U.P. (2) That the use does not meet all required conditions and specifications; (3) That the use will substantially injure the value of adjoining or abutting property, or that the use is a public necessity; and (4) That the location and character of the use if developed according to the plan as submitted and approved will not be in harmony with the area in which it is to be located and in general conformity with the town Land Use Plan and policies

Minimum square footage Each dog shall be provided a minimum square footage of floor space equal to the mathematical square of the sum of the length of the dog in inches, as measured from the tip of its nose to the base of its tail, plus six inches, then divide the product by 144.  The calculation is: (length of dog in inches + 6) x (length of dog in inches + 6) = required floor space in square inches.  Required floor space in square inches ÷ 144 = required floor space in square feet.
