Fire Protection and Prevention Act Municipal Responsibility Must establish program of public education and certain components of fire prevention. FPPA 2.(1)(a) Must provide other fire protection services in accordance with needs and circumstances. FPPA 2.(1)(b) May develop and implement inspection programs through comprehensive fire risk assessment – focus on high/extreme risk occupancies. PFSG’s issued under authority of FM to assist municipalities and Fire Departments with development of fire protection programs and services.
Fire Protection and Prevention Act Mandatory Assessments New O.Reg.364 requires mandatory fire safety inspection & observation of fire drill to be done in care occupancies, care and treatment occupancies and retirement homes. New O. Reg. 365 requires fire safety complaints/ requests be assessed and an inspection be undertaken if deemed necessary. New FM directives support the regulations.
Fire Protection and Prevention Act Inspections Authority to inspect, without warrant for the purposes of assessing fire safety. FPPA 19.(2) Authority to enter, without warrant when it is believed that a risk of fire poses an immediate threat to life for the purpose of removing/reducing threat. FPPA 15.(1) Sec 15.(1) Remove persons Post a fire watch Remove combustibles or explosive material or anything that may constitute a fire menace Note c.1- disposal as per FM directive Eliminate ignition source Install temp safe guards including fire extinguishers and smoke alarms Make minor repairs to existing fire safety systems Do anything the assistant to the fire marshal has reasonable grounds to believe is urgently required to remove /reduce the threat to life.
Fire Protection and Prevention Act Orders May order owner/occupant to address risk and/or remedy Fire Code contravention FPPA 21.(1) Upon approval of FM an inspector may order owner/occupant to close the premises until corrective actions taken as outlined in an Inspection Order FPPA 21.(2)(a) CBO to receive a copy of an Inspection Order requiring repairs, alterations or installations to be made to a building FPPA 22.(3)
