Procedure for Spain to sign the ELIXIR Consortium Agreement (ECA): actions and processes Spain signed the MoU interim phase - September 9th, 2011. As a signatory, Spain is an Observer country now after the ECA came into operation. Letter of the Secretary of State R+D+I of Spain to the Director of ELIXIR: March 28th, 2014. Letter of the Secretary of State R+D+I of Spain to the Director of ELIXIR communicating the decision to joint and institutional procedure iniciated: October 30th, 2014. The ELIXIR Board meeting in Hinxton, November 3rd -4th, 2014, agreed to consider Spain as a full member for the purposes of participation in ELIXIR’ s current applications to H2020, under the condition that the ECA is signed by the Government of Spain and ratified by the time of the award of the grant. Gov. interdepartmental process. Ad Hoc Coordinating Group. ISCIII is mandated to represent Spain and financially contribute to ELIXIR. The mandatory legal process to the approval of the economic commitments by the relevant Authorities to subsequently sign the ECA. . 3

Procedure for Spain to sign the ELIXIR Consortium Agreement (ECA): actions and processes Spain Initiated the mandatory legal process to the approval of the economic commitments by the relevant Authorities to subsequently sign the ECA. The Spanish voluntary funding contribution 2014 to ELIXIR: 86,000.00 €. ISCIII had the appropriations, but failed to deliver it before fiscal year closing, due to the special situation of ELIXIR. As a second time, a process of payment is feasible but more complex now. The Spanish funding contribution 2015 to ELIXIR: 364,337.00 €. The appropriations were included in the National Budget 2015 enacted by the Spanish two Chamber Parliament: Act 36/2014, of December 26th. The payment to ELIXIR is split in two separate different processes: 100,000.00 € by ISCIII and directly earmarked. 264,337.00 € from appropriations provided by ISCIII to 6 INB nodes. 4

Procedure for Spain to sign the ELIXIR Consortium Agreement (ECA): actions and processes The payment of the Spanish contribution 2015 to ELIXIR is split in two: A process of directly earmarked 100,000.00 €, by ISCIII. The procedure for any Spanish public institution cross border payment to an international body, such as EMBL, requires the mandatory authorization of the Council of Ministers of Spain, prior to the bank transfer. The internal process at ISCIII, including the Certification of the relevant appropriation, has been finished. Counsel for the State ´s report. Ex ante Public Auditor ´s report. The dossier is at MINECO to be submitted to the Council of Ministers of Spain, for the approval. After the communication of the approval to ISCIII, the deliver of the bank transfer order to ELIXIR is expected fast (i.e. a matter of days). 5

Procedure for Spain to sign the ELIXIR Consortium Agreement (ECA): actions and processes The payment of the Spanish contribution 2015 to ELIXIR is split in two: A process of 264,337.00 €, from appropriations provided by ISCIII to 6 INB nodes. It requires a legally binding agreement between MINECO, ISCIII and 6 INB nodes at the purposes of funding and scientific contribution to ELIXIR. The internal process at ISCIII has been finished already with Counsel for the State ´s report. Ex ante Public Auditor ´s report. The dossier is at MINECO pending to receive a certification of each 6 INB nodes ring fencing the relevant appropriations. Need of “green light” by the Ministry of Public Finance and Administration (issue: regions with nodes if such regions have overpassed the cap maximum Public Finance Deficit, i.e. Catalonia). To be submitted after to the Council of Ministers of Spain. 6
