VW Settlement Agreement Scott Davis EPA Region 4 State & Local Air Directors Meeting November 10, 2016

VW Partial Settlement Agreement Original complaint filed January 4, 2016 on allegations for Clean Air Act violations on approximately 475,000 vehicles with defeat devices installed to cheat on federal emissions tests. Affected model years 2009-2015 2.0 liter diesel engines. Called a partial settlement agreement because it addresses what VW must do to address 2.0 L vehicles on the road and pollution but not other US Dept of Justice complaints. EPA and Federal Trade Commission are parties to the agreement.

VW Partial Settlement Agreement  US District Court, Northern District of California issued consent decree (Senior District Judge Charles R. Breyer) Proposed partial consent decree issued on June 28, 2016 30 day comment period closed August 5 (1195 comments) Final consent decree issued on October 25, 2016 

VW Partial Settlement Agreement Total of $14.7 Billion $10.033 billion Buyback Program $2.0 billion Zero Emissions Vehicles and Infrastructure $2.7 billion NOx Mitigation (to States and Tribes) Vehicle owners can select Buyback (they will also receive restitution of $5100 to $10,000) or Emissions Modification (however there is no EPA/CARB approved modification currently)

VW Partial Settlement Agreement Final Consent Decree provides ALL next steps (237 pages) First step is to nominate and select Trustee Governor elects to participate by contacting Trustee (deadline to meet) Governor appoints State agency to implement mitigation actions Funds for mitigation must meet eligible criteria in final order (see Appendix D-2) Your Attorney needs to read the Final Order - NOW !
