FMLA: Family & Medical Leave Act Family and Medical Leave Act (FMLA) entitles eligible employees of covered employers to take unpaid, job-protected leave for specified family and medical reasons. FMLA also includes certain military family leave provisions. Limited to 12 weeks of leave within 12 month period Diocesan policy uses “rolling 12-month method” of counting time
FMLA: Family & Medical Leave Act Cannot start counting the 12 weeks until employer notifies the employee that leave is considered FMLA Should be using FMLA for any leave of absence requested Leave periods of 2 weeks, or more, should be considered FMLA and do the paperwork
FMLA: Family & Medical Leave Act Keep in mind that not all employees are eligible – must have: Been employed by employer for at least 12 months in the last 7 years; Worked at least 1250 hours in the 12 months preceding the start of leave; and Worked at site with at least 50 employees within 75 miles
FMLA: Family & Medical Leave Act The “Take Away”: If you have an employee going on a leave of absence of 2 weeks or more – Call Diocese HR office
Terminations Performance issues – Document, document, document – can’t have too much!! Warning(s) should give the employee a timeframe in which to improve Be very clear regarding consequences if correction is not made! Remember: prior to any termination, you must call me or Royce (or an attorney); your liability coverage will not be in force if you don’t!
