Political context Shortcomings identified in the RFD; Commission proposes an appropriate follow-up to the review of the Reporting Formalities Directive, including the establishment of an harmonised EMSW environment; Commission highlights the need for an up-to-date legal framework; In particular ECSA urged the EU to give "Absolute priority ... to a fundamental overhaul of the EU Reporting Formalities’ Directive. The revision should lead to a true European single window environment".

The view of DG MOVE (1) DG MOVE: “This situation is not ideal, since it confronts operators with systems that are differentiated between MSs; it might also be illegal, whenever differences persist within any MS.”

Comments DG MOVE “If PCS is part of a SW solution in a Member State, then the PCS should comply with all requirements imposed by the Directive / National legislation, incl. a harmonized interface…” “The EMSW environment will include a fully harmonised electronic manifest encompassing cargo formalities required by both maritime and customs authorities.”

Next steps DG MOVE: Evaluation RFD and Peer Reviews – until summer 2017 Stakeholder consultation until summer 2017 EMSW and eManifest projects until end 2017 Start drafting revised RFD from January 2018 Impact Assessment for options until April 2018 Publication of revised RFD expected in June 2018 IMO: SW Guidelines through FAL42 in June 2018 (IMO does not make use of NSW prototype of EMSA, start from 0
