State Charts At the heart of the Ultimate Guide to State Drug Testing Laws are the state charts. There is one for each state and applicable municipalities. Detailed categories of information are provided for the most commonly asked questions. The first section of each chart deals with drug and alcohol testing “Policy Issues.” It will tell you if, for example, pre-employment testing is addressed in the statute, whether it is permitted (or required) or not, and then provide additional details if necessary. The Next Two Sections… The third and fourth sections address “Outcomes” and “Incentives and Penalties”. If you want to know, for example, if employees have the right to request a “retest” or if there are criminal or civil penalties for breaking the state’s drug testing law these last two sections will tell you.
There’s More Finally, because additional information often is needed a “Notes and Statutory Language” section contains further details regarding that state’s law. Language is typically taken directly from the statute and included in this section. The Notes section may have definitions that are particular to that state, an explanation of random testing, specific results reporting requirements, or virtually anything else that may set that statute apart from other states.
A Comprehensive Service Periodic updates, which are sent out as we learn of changes in the law or when clarifications are provided, include notification of the change and an updated state chart if necessary. When you call or email for additional information we attempt to answer your question immediately but always within 24 hours. A full written report in response to a question may incur additional fees when approved in advance by the subscriber. However, this is rarely needed.
