A fair ‘Super Split’ for all Western Australia- A fair ‘Super Split’ for all Western Australia is the only state in Australia where superannuation splitting for de facto (and same sex) couples is not considered to be an asset that is available to be split. When the Family Law Amendment (De Facto Financial Matters and Other Measures) Act 2008 was passed, the Commonwealth did not pursue the opportunity to provide the WA Family Court with power to make superannuation splitting orders. HESTA is seeking this change because we believe that by remaining outside of the framework, Western Australians living in de facto relationships, including same-sex couples, face very different financial outcomes in the instance of a relationship breakdown than their married counterparts.
