IFRRO AGM 2012 Status Reports from CWWCS Zhang Hongbo, Director General China Written Works Copyright of China (CWWCS)

China Written Works Copyright Society (CWWCS), the sole CMO on written works in China, was founded four years ago. Yesterday was her birthday. Regardless of our great efforts, it’s still unable to carry out the licensing on photocopy or reproduction, or the collecting of reproduction royalty fees. When could we end the time of copying books and articles free of charge in China? That’s why we applied for joining IFRRO. Today, we’re here for your suggestions and supports.

1. Amendment of The Copyright Law of China At present, the Chinese publishers, authors, or the Publishers’ Association, the Authors’ Society and the Translators’ Society seldom realize the importance of reproduction rights, and they seldom receive the royalty fees from reproduction rights and have no idea on licensing to the RROs abroad. Print on demand is almost without any authorization from the copyright holders. Also, it’s difficult for overseas publishers or authors to protect their reproduction rights in the territory of China.

1. Amendment of The Copyright Law of China Currently The Copyright Law of China is under the process of amendment, and the draft would be presented to the State Council at the end of November or the beginning of December. That’s to say that we need your practical opinions or suggestions on the draft, especially on the reproduction rights’ collective management. We have the draft in both Chinese and English at hand.

2. Extended Colletive License Collective management is an important system on the management and protection of "small rights". Social environment and public awareness of copyright in China showed that during a long time it is impossible for all the publishers and authors to become CWWCS’ members, but some of them would be, I believe.

2. Extended Colletive License As a result, how to protect the "small right" of CWWCS’ non-members’ has already became a social problem. Therefore during the process of amendment of The Copyright Law of China, we insist that the introduction of "extended collective license" from Northern Europe could be the best option to solve this problem. We look forward to your support from abroad.

3、International Cooperation In addition to the authors, CWWCS will absorb some publishers, magazines or newspapers soon. Therefore, CWWCS will represent the Chinese copyright holders of written works to the largest extent. So we’d like to cooperate with the other RROs and give license to them.

3、International Cooperation CWWCS has been discussing the issue on the unilateral agreements with CLA, CAL, COPYRUS, COPYRO, CLASS, VIETRRO, AIDRO and SIAE. We are willing to cooperate with the other RROs to promote the protection on the reproduction rights for every works, and take the opportunity to push the establishment of relative systems in China.

4、Digital rights: the priority development direction of CWWCS Meanwhile, CWWCS has cooperated with www.amazon.cn and China Mobile in the field of digital rights license. Nowadays, digital rights have been the priority development direction of CWWCS.
