Chapter 14 LEGAL FRAMEWORK Occurrence reporting, evaluation and storage is regulated by: Law on Air Transport, “Official Gazette of MNE” No. 30/12 from 8 June of 2012 State Safety Programme (June 2012) Regulation on Occurrence reporting Analyzing , Storing and Dissemination of aviation occurrences, serious incidents and accidents, “Official Gazette of MNE” No. 14/2013 from 23 March 2013. INSTITUTIONAL FRAMEWORK Chapter 14 INSTITUTIONAL FRAMEWORK The CAA of Montenegro and National commission for ACCID/INCID investigation are responsible bodies for collection, evaluation storage and dissemination of aviation safety occurrences data. Chapter 14 SYSTEM ENABLES Mandatory Reporting - Penalties for non compliance - Article 161 provision 26 of the Law on Air Transport Voluntary reporting is encouraged - Article 130 of the Law on Air Transport Voluntary/Non punitive reporting for inadvertent infringements – entrusted to National commission for ACCID/INCID investigation - Article 130 Law on Air Transport and Article 8 of the Reg. 14/2013 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 14
CONFIDENTIALITY AND DATA PROTECTION Chapter 14 CONFIDENTIALITY AND DATA PROTECTION Protection and Disidentification of personal data ensured trough Regulation 14/2013 Article 5 and Article 7, implying establishment of Contact Persons within the CAA and National Commission and the Responsible Person within the industry organization Reports are supposed to be submitted to the Contact Persons Contact Persons are the only ones to have access to the reporters personal data All personal data must be removed from the report prior to being entered in the database - Article 14 of the Regulation 14/2013 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 14

Chapter 14 CONCLUSION The Law on Air Transport and Regulation 14/2013 fully implement the Directive EC 2003/42 and Regulations EC 1330/2007 Implementation of the Regulation EC 1321/2007 will be possible upon Montenegro becomes full EU member M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 14
