Background Key Legislation 1996 White Paper on National Transport Policy 1997 National Environmental Management Act 2004 Air Quality Act The Constitution of the Republic International Instruments

Purpose of the Charter Adopt a cluster approach to the three variables Enable the DOT to play an active role in reducing health and environmental externalities associated with transport Integrate health and environmental considerations in transport and land-use planning Support relevant legislative mandates of the three Departments Promote co-operative governance

Organisation of the Charter The Charter itself (chapter 9)is divided into six sub-sections, namely Preamble Evidence of adverse effects of transport on both health and environment A call for harmonisation of policies across the three Departments Principles Strategies, in relation to the principles outlined Plan of Action

Consultation Internal consultation ongoing National Departments represented on the Committee for Environmental Co-ordination (CEC), September 2006 Department of Environmental Affairs and Tourism (awaiting their final consolidated inputs) Health, March 2007 (document sent to DOH)

Co-operative Governance Section 41 of the Constitution calls for co-operative governance Section also calls for promotion of intergovernmental relations Chapter 3 of NEMA also calls for the above This is being promoted by the DOT regularly through liaison with the CEC Health now on board to complete the link with Transport and Environmental Affairs

Way Forward & Timeframes Document already approved by the DG of Transport, subject to submission to Economic Cluster. Inputs from all Departments and their stakeholders will be considered and consolidated into the final draft of the Charter. All the relevant Ministers to give effect to the Charter by way of signing the finalised document, April 2008.
