Constitution Amendment for Chapter Ratification 2016 Tau Beta Pi Convention Constitution Amendment for Chapter Ratification

Overview The Executive Council proposed an amendment to the Constitution to addresses items overlooked during the restructuring approved at the 2015 Convention. The 2016 Committee on Constitution and Bylaws reviewed the proposal, made changes, and presented the revised proposal to the delegates. After debate and amendment, the delegates at the 2016 Convention approved the changes by a vote of 256 in favor and 2 against. The changes must be reviewed and voted on by the chapters. Passage requires an affirmative vote of 3/4 of the active chapters.

Executive Council Restructure The amendment approved at Convention: Grants the power to set the size of the Executive Council to the Convention. Removes references to election by groups since members of the Executive Council are now elected individually. Updates the election procedure to handle individual election of Executive Council members instead of election by group. Clarifies that Executive Councillors must wait a year between serving, instead of be elected to, more than two consecutive terms on the Executive Council. Changes alumnus to alumni. Makes other minor wording changes.

Proposed Change – Article III, Section 2 Proposed Wording Current Wording Sec. 3: (e) The Convention shall set the size of the Executive Council. (f) The Convention shall elect the members of the Executive Council as hereinafter provided and fill vacancies for the remainder of the terms of office vacated. See Const. Art. III, Sec. 3 (g) and Const. Art. III, Sec. 6. All subsequent clauses shall be renumbered as required. Sec. 3: (e) The Convention shall elect the members of the Executive Council as hereinafter provided and fill vacancies for the remainder of the terms of office vacated. See Const. Art. III, Sec. 6.

Proposed Change – Article III, Section 3 Proposed Wording Current Wording Sec. 3: (a) The Executive Council shall consist of no more than twelve voting members who are alumni and no fewer than the minimum in accordance with state law. They shall serve without compensation for staggered terms of three years, or until their successors are chosen and qualified. The members of the Council shall be elected by the Convention. Members are limited to two consecutive three‐year terms with at least one year off before being eligible to take office again. The Executive Director shall serve as a non‐voting member of the Executive Council. Sec. 3: (a) The Executive Council shall consist of no more than twelve voting alumnus members and no fewer than the minimum in accordance with state law. They shall serve without compensation for staggered terms of three years, or until their successors are chosen and qualified. The members of the Council shall be elected by the Convention. Members are limited to two consecutive three‐year terms with at least one year off before being eligible to be elected again. The Executive Director shall serve as a non‐voting member of the Executive Council.

Proposed Change – Article III, Section 3 Proposed Wording Current Wording Sec. 3: (b) Any chapter, collegiate or alumni, may nominate one or more members who are alumni to serve on the Executive Council. Such nomination shall be made to the Executive Council before April 1 preceding the Convention at which the election is to be held. Elections shall be held every year. Sec. 3: (f) The Convention shall vote only on the nominated individuals, except that if the number of nominees is less than the number of vacancies, any delegate to the Convention may nominate eligible members who are alumni to serve on the Executive Council, provided the delegate is certain that the nominees are willing to serve if elected. Sec. 3: (b) Any chapter, collegiate or alumni, may nominate one or more alumnus members to serve on the Executive Council. Such nomination shall be made to the Executive Council before April 1 preceding the Convention at which the election is to be held. Elections shall be held every year. Sec. 3: (f) The Convention shall vote only on the published groups, except that if only one group has been nominated, any member of the Convention may nominate group of alumnus members to serve on the Executive Council, provided the member is certain that the nominees are willing to serve if elected.

Proposed Change – Article III, Section 3 Proposed Wording Current Wording Sec. 3: (g) Each vacant seat on the Executive Council shall be filled in turn by the favorable vote of a majority of the qualified voters registered at the Convention. All nominees who have not been elected to a seat on the Executive Council shall be candidates for the seat under consideration. Voting shall be repeated until the seat is filled. If a candidate receives a majority or if only one candidate remains, that candidate shall be elected to the seat. If no candidate receives a majority, the candidate receiving the fewest votes shall be dropped from further consideration for the seat in question. The numerical results of each ballot will be made known to the Convention before any subsequent ballots are cast. Sec. 3: (g) A group of candidates for the Executive Council must be elected by the favorable vote of a majority of the qualified voters registered at the Convention. A vote by the Convention will cause the nominated group receiving the least number of ballots to be dropped from further consideration until a group receives a majority vote. The numerical results of each ballot will be made known to the Convention before any subsequent ballots are cast.
