The legislation Statutory Instrument 2003 No. 1993, The Public Interest Disclosure (Prescribed Persons) (Amendment) Order 2003.. refers Because the Secretary of State says so Whistleblowing to the CAA – why are we involved? The UK CAA is a Prescribed persons / Bodies

The CAA responsibility Transport Civil Aviation Authority: “the prescribed body” about compliance with the requirements of civil aviation legislation, including aviation safety and aviation security.

What is whistleblowing? Whistleblowing is the term used when a worker passes on information concerning wrongdoing. e.g. criminal offences , for example, types of financial impropriety such as fraud etc. failure to comply with an obligation set out in law miscarriages of justice endangering of someone’s health and safety damage to the environment covering up wrongdoing in the above categories

Who is classed as a whistleblower? The Public Interest Disclosure legislation provides for employees However the CAA receives Whistleblowing reports / allegations from numerous sources :- Customers Competitors Ex-employees Students / Parents Public If the allegation is in the public interest we log it as a whistleblower. WRT to P 147 Ex employee bear a grudge Competitor Parents

Typical Allegations An aircraft owner who’s aircraft maintenance has not been completed as certified by the maintenance organisation. An employee identifying non-compliance with the legislation by their employer. Falsification of Part 147 examination results. ……. Cheating. Part 66 Licences being obtained by fraudulent means. …….. Certificates of Recognition. Practical training / OJT being falsely claimed by an applicant.

Dealing with a Whistleblower The CAA is the “Prescribed Person” / Body for whistleblowing allegations relating to aviation. Whistleblowers are directed to a CAA coordinator or to the information on our website An Email is easiest way to lodge the report Although a ‘confidential’ report is preferable we also accept ‘anonymous’ reports. An “experienced” surveyor is assigned to conduct a Preliminary Investigation (PI) to ascertain if there is a case to answer. In some cases, not all, the CAA Enforcement team become involved. CAA coordinator Sean Parker Upmost confidentiality at all times Meet with the whistleblower in a neutral location

Allegations across the disciplines

How many allegations? Culture? The CAA received 140 Whistleblower reports in 2015 30 related to Airworthiness of which 10 were Part 147 related. Employee whistleblower = issue with normal reporting process? Culture? Over 20 Part 147 20,000 Occurrence reports in 2015
