Legal Options After Being Injured as a Motorcycle Passenger

Claims can be made against the following entities: As an injured passenger of a motorcycle accident, you may make a claim against different entities responsible for causing your injuries. Claims can be made against the following entities:

The Motorcycle Operator Poor decision-making or negligence on the part of the motorcycle operator may lead to a serious accident. Negligence may take a variety of forms, such as speeding, improper lane change, improper turns or failure to maintain or repair the motorcycle. If the motorcycle operator committed any of these acts which led to the accident, you may make a legal claim against the operator.

The Driver of the Other Vehicle If your injury was caused by a collision with another vehicle, you may be able to bring a claim for your injuries against the driver of the other vehicle.

The Repair Shop, Mechanic and Manufacturer When brakes or turn signals are improperly repaired and cause an accident, the repair shop or mechanic may be held responsible for the accident. If a defect in the design or manufacture of a motorcycle or one of its components causes an accident, the manufacturer may be held responsible.

The Government Entity Involved When a roadway defect such as a pothole, bridge seam or undulating asphalt causes an accident, the government entity involved, whether it is state, county, city or town, may be held legally liable.

Your Insurance Company If you live in a “no-fault” insurance state, you may be able to bring a claim for personal injuries against your own insurance company. In other states, victims may be able to pursue compensation through the uninsured/underinsured motorist portion of the vehicle insurance policy.

If you have been injured in a motorcycle accident, Ganim Injury Lawyers can help. We will work aggressively to help you receive the compensation you deserve. We will fight to protect your interests.
