Transposing the Directive Chapter 27: Environment and Climate Change Transposing the Directive  The provisions of Directive 2002/96/EC were transposed in the following regulations in Montenegro: Law on Waste Management (Official Gazette of Montenegro, 64/11), Decree on the manner and procedure for establishing a system of acquisition acceptance, collection and treatment of waste from electrical and electronic products and operation of the system (Official Gazette of Montenegro, 24/12) About 90% of Directive 2002/96/EC was transposed to the applicable regulations. Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Legal Framework   Measures are prescribed obliging manufacturers of electrical and electronic products and equipment to produce these products and equipment, and implement manufacturing processes in a manner that allows easy disassembly and assembly of equipment. Prescribed measures specifically relate to reuse and disposal of waste from electrical and electronic products, their components and materials, unless otherwise production or manufacturing operations represent a significant advantage for the protection of the environment, public health or general product safety. Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Legal Framework   Pursuant to Article 47, paragraph 3 and 4 of the Law on Waste Management (Official Gazette of Montenegro, 64/11), the Government of Montenegro, at the session of 5 Aprila 2012, adopted the: ‘Decree on the method and procedure for establishing a system of acceptance, collection and treatment of waste of electrical and electronic products and operation of the system’   M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Chapter 27: ENVIRONMENT

Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Legal Framework This Regulation shall apply to the equipment referred to in Annex 1, which is attached to this Decree as an integral part, if the equipment is not an integral part of the machinery and vehicles and is not incorporated into the structures or building as an integral part. This Decree shall not apply to : - Waste printing toners, categorized as waste with the catalog number 08 03 17 * and 08 03 18 * in the Waste Catalogue, if developed as a consumable item using printers, - Equipment for national security, - Equipment that is built into the arms, ammunition and military equipment.   M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE

Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Current Situation   In accordance with the projection, which is done on the basis of our experience and of the European Union, the estimated amount of waste from electrical and electronic products, which is produced annually by households and similarly for legal entities varies from 7 to 12 kg/capita, or for the whole territory of Montenegro no less than 4200 tons per year,   M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Chapter 27: ENVIRONMENT

Planed activities-goals Chapter 27: Environment and Climate Change Planed activities-goals The processor of waste equipment shall in accordance with the National Waste Management Plan by 1 January 2020: Provide recovery for at least 80% and reuse or recycling of component parts and materials of waste equipment for at least 75% of the collected waste equipment referred to in items 1 and 10 of Annex 1 of this Decree. Provide recovery for at least 75% and reuse or recycling of component parts and materials of waste equipment for at least 65% of the collected waste equipment referred to in items 3 and 4 of Annex 1 of this Decree. Structure and Implementation Chapter 27: Environment and Climate Change Structure and Implementation Supervision over implementation of the Law on Waste Management and this regulation shall be performed by the Ministry of Sustainable Development and Tourism and the relevant local government bodies. Inspection is conducted by environmental inspectors. Inspection supervision of the existence of labels with the producer’s name and labels on mandatory separate collection of waste generated from products for which the extended producer responsibility is prescribed shall be carried out by market inspectors.    A fine of 500 to 20,000 euros shall be imposed on a legal entity if mixing the waste from electrical and electronic products with other wastes.   M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE

Administrative Capacity Chapter 27: Environment and Climate Change Administrative Capacity       Employees: Ministry of Sustainable Development and Tourism (4 employees) Environmental inspectors for inspection of EE waste (7 employees) Market inspection (no employees) for verifying the existence of labels for mandatory separate collection of waste generated from products for which extended producer liability is prescribed The Environmental Protection Agency (3 employees) shall be responsible for: keeping records on waste, keeping a register of collectors, dealers and intermediaries, issuing permits for the recovery and / or disposal, keeping a register of information on waste generation and management on the basis of data from the annual report on waste   M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE
