Tale of the Tape Thomas Jefferson, John Adams, Charles Pinckney and Aaron Burr Run for the Presidency of the United States in 1800 Federalists Claimed that Jefferson Was a pro French Radical who would lead a violent revolution here while he destroyed Religion Democratic Republicans claimed Adams wanted to Make himself a king and would use the Army to limit people’s Freedoms

Court Marshall Before Adams left the presidency he passed the Judiciary Act of 1801 allowing him to appoint 16 federalist judges to the federal courts to keep federalists in a role of power Since Justices were appointed for life, Jefferson was powerless to change them as some of them were appointed before midnight on the day Adams left power Adams also appointed John Marshall as chief justice where he would serve for over 3 decades

Bury Bury Mad Chief Justice Marshall would preside over the Case of Marbury v. Madison(1803) John Adams Would appoint William Marbury as Justice of the peace of Washington DC but the Documents were not able to be approved by Adams When James Madison Refused to Appoint William Marbury forcing Marbury to sue to gain his appointment Marbury’s case would make it to the Supreme Court Allowing Federalist Marshall to decide the case

Marshall Law Justice Marshall Decided that Marbury V. Madison could not be heard as it did not fit as a case the Supreme Court had authority on Marbury v. Madison set up Judicial Review giving the Supreme Court final say on constitutional matters Marshall seized new powers for the supreme court, but since it was used to the Democratic Republican’s benefit, Jefferson could not fight it This decision would set up a lasting Checks and Balances system still in effect today
