What’s new for 2016-17? Communication

IMPACT OF HB 7029

Non-Member Private School (less than 125) Initial Eligibility Has always been determined by the school, unless the school request an eligibility ruling (EL10) Non-Member Private School (less than 125) Are treated the same as Charter School Students – if a sport is not offered, may play at their zoned public school

Eligibility Standards Student eligibility standards and related disciplinary actions MUST be included in the Student Code of Conduct Membership by Sport Private schools have the option of full membership or joining by sport Public schools may apply for consideration to join another association

Transfer Eligibility A student who transfers is immediately eligible as long as all other eligibility requirements are met Students may not participate in the same sport in the same year at more than one school (unless one of the exceptions are met) Children of active duty military whose move resulted from military orders Children relocated due to foster care placement Children who move due to a court-ordered change in custody due to separation, or serious illness or death of custodial parent Good cause policy in district or charter (district placement) Mid-season transfer may seek to join the team under certain conditions

Transfer Eligibility Before a sport season Full and complete move 2015-16 (Before HB 7029) 2016-17 (After HB 7029) Before a sport season Full and complete move Necessary relocation Reassignment by district Within the first 20 days Marriage of student Has not participated in the sport After the start of the season Roster spot available Must have requisite skill set May not have participated Exceptions to prior participation: Active military duty move orders Change in foster care placement Court-ordered change in custody Good cause of school district policy

Recruiting Penalties Recruiting violations targeting school district employees and contractors include incremental punishments: First offense- $5,000 forfeiture of salary payments Second offense – suspension without pay from coaching for 12 months and $5,000 forfeiture of salary payments Third offense - $5,000 forfeiture of salary payments and automatic review of teaching certificate (if probable cause is found, certificate shall be revoked for 3 years Determined by a “preponderance of evidence” These are not fines to be collected by the FHSAA

Important Bylaw and Policy Changes Bylaw 9.2.4 – Eliminates previous contact restrictions – unless recruiting, improper contact, or impermissible benefits Bylaw 9.2.5 – Eliminates relocation of coach – unless recruiting, improper contact, or impermissible benefits Policy 36 & 37 – Includes the penalties for recruiting along with the other possible FHSAA sanctions
