IEPs Information from the SDE indicates the need to address the differences in accommodations on the new tests for all IEPs (that fall into the age/grade groups to be tested) Yes, that’s right – ALL IEPs 3 ways to handle Notice to parent – if accommodations are similar to existing accommodations IEP Amendment (SR) with/without meeting AR

Notice to Parents IEPs that have PASS accommodations similar to those that we anticipate Aspire will have will only require a notice to parents Enrich will be making these updates over the next few weeks This will apply to the majority of IEPs Exception will be IEPs with oral admin for PASS ELA and English Will involve Add IEP Amendment cover page Clarifying addendum Do not click Amend on IEP Details Send the notice home using 2 different methods

Iep amendment (SR) with a meeting On Programs tab, click Schedule Meeting Choose Yes, additional items will be discussed and choose Spring 2015 tests Add Action – IEP Amendment cover page “Assessment participation – state assessment accommodations” Details Click Amend

Annual review You’re creating a new IEP and will address this as part of the meeting Follow your usual procedure for an AR

Reminders Initial referrals Make sure you have a process in place that processes referrals from both your RtI team and from parents in a timely manner There must be documentation of the interventions attempted, the progress monitoring that was done, and the communication of this progress to the parents to account for time between the referral to RtI and the referral for special education (if that occurs) If this is a parent referral that has not gone through RtI, you must run the RtI process at the same time as the evaluation process to gather data to help the eligibility team determine whether the problems are due to lack of appropriate instruction or to a disability

Look and listen for the clearly articulated trigger words from parents Test IEP Evaluate Special education Disability Look and listen for the less clearly articulated trigger words Help Assistance Support

Don’t let the parent’s lack of response in turning in information (like the developmental history) delay the referral If you are missing information from the parent as part of the referral, note your attempts to get the information and proceed with the referral; include that documentation in your referral packet Gather that missing information as part of the evaluation process Turning in a timely referral packet to proceed with the evaluation process is your documentation that you are fulfilling your Child Find obligations You have no leg to stand on if the parent complains about how long the process takes if you haven’t turned in the referral packet and scheduled an evaluation planning meeting in a “timely fashion” “timely fashion” – the length of time you could defend on the stand in a due process hearing

If this is a parent referral and the school has no reason to suspect a disability, gather the referral packet information and discuss with your District Sp Ed Coordinator; you have 2 options: If you and the DSEC agree there is no reason to suspect a disability, the school can refuse to evaluate; notify the District Office of the decision and provide the justification as to why and a PWN will be sent to the parent If you proceed to an evaluation planning meeting, review the existing information and determine the student is not eligible for special education

Denial of fape meetings Must be done through an IEP meeting; cannot agree to amend without a meeting Must use the agenda on the BookShelf or similar document Upload in Enrich once completed Must complete a compensatory services plan if the team determines there was a denial of FAPE Upload in Enrich Once the compensatory services are completed, must have an IEP meeting to discuss the completion SR or AR
