Gretchen Means, Title IX Coordinator Executive Director Office of Equity and Diversity

What Issues? Prohibited Conduct * Sexual assault – penetration without consent. * Sexual contact – touching without consent. * Non-consensual viewing, videotaping * Exposure. * Intimate Partner Violence * Stalking

What Issues? Harassment Hostile Environment, Quid Pro Quo Based on (not of) a protected class.

USC’s Jurisdiction To investigate and discipline: Student misconduct – if Respondent is a USC student, acts can occur anywhere, anytime. Faculty and Staff Employee misconduct – in most instances, acts must occur on campus/during the course of University functions.

USC’s Jurisdiction To prevent/remediate: Student misconduct – Law and guidance is proactive; USC must take action to prevent. Faculty and Staff Employee misconduct – Law and guidance is retrospective; USC must balance prevention against unlawful employment actions.

Your Role Commit to privacy, not confidentiality. Determine if Reporting Party feels safe. Call/email OED/Title IX as soon as possible. All faculty are “Responsible Employees”. If there are safety issues (domestic violence, expressed fear, stalking, high stakes) call DPS IMMEDIATELY. 5. Keep close hold. Very close.

Your Role Allow disclosure but do not question Reporting Party and do not investigate. These issues are GRAY. Very, very GRAY. Good news – not up to you to see black and white before you report. There is NO “threshold” of evidence or credibility that must be reached before it must be reported…
