Using Background Checks for Adverse Action If an employer, such as Rosse Corp., uses information from a background check for denying the job applicant, terminating the employee, or rescinding a job offer, they must take the following steps: Before action is taken, employer must give the applicant a copy of the report and an explanation of the applicants rights under the FCRA. After the action is taken, the applicant must be given: a document containing the name, address and phone number of the screening company; a statement the screening company did not make the adverse decision (rather that the employer did); and a notice that the individual has the right to dispute the accuracy of the report.
