Participants, Patents, and Duty to Inform June 2010 All participants in this meeting have certain obligations under the IEEE-SA Patent Policy. Other Guidelines for IEEE WG Meetings June 2010 All IEEE-SA standards meetings shall be conducted in compliance with all applicable laws, including antitrust and competition laws. Don’t discuss the interpretation, validity, or essentiality of patents/patent claims. Don’t discuss specific license rates, terms, or conditions. Relative costs, including licensing costs of essential patent claims, of different technical approaches may be discussed in standards development meetings. There is no need for backwards compatibility with 2.45 GHz ISM operation. June 2010 Adrian’s Opinion “I have absolutely no desire to impede progress in TGaf,  but there are some things I think your group needs to be sensitive to.” Is this an official TG meeting,  or a group of friends getting together?   As regards antitrust,  it would do well for any group of competitors meeting together to be reminded of antitrust requirements, and observe these rules. As to patent, issues,  if there were attendees at this meeting who contribute IP,  but do not attend any official meetings,  they might be unaware of the IEEE rules,  and not given an opportunity to declare any known holders of IP. As to notice,  the 10-day rules is there so that nobody is disadvantaged – i.e. they can’t claim “I didn’t know about the meeting because I was on holiday/in the bath;  so your process is not fair” “I’m increasingly convinced you should make this an official TG meeting;  thereby ensuring you operate under (and are indemnified by) well defined rules.    We can easily add meetings,  provided that you don’t need one within the 10-day period.” Rich Kennedy, Research In Motion
