Carl Weimer, Executive Director April 3 - 6, 2017 Banff Pipeline Workshop – Plenary Address

The Pipeline Safety Trust Who we are and where we came from? We are the only national non-profit organization that focuses on pipeline safety issues from a public interest view April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Banff Pipeline Workshop - Plenary Address How we came into being “… there’s going to be a Trust that’s going to be funded as part of today’s sentencing. With $4,000,000 … they’ve nowhere near the lobbying potential of the oil industry. It’s not even David and Goliath. It’s more like Bambi and Godzilla. You’ve heard people today that are going to spend their lives trying to make this right, and they should be listened to. No industry polices itself very well… you need outside people, and these are going to be the people so pay attention to them.”   The Honorable Barbara Rothstein United States District Judge At Olympic Pipe Line Co Sentencing April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

The Pipeline Safety Trust What we do? • Work to improve pipeline safety regulations • Provide increased access to pipeline safety information – website, conference, listservs • Provide a “public interest” voice to pipeline safety processes and at a variety of meetings • Serve as the public voice to the media looking into pipeline safety incidents and rules • Partner with groups trying to move pipeline safety forward. • Provide technical assistance to impacted communities. Why Pipeline Safety Matters to Everyone April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Why Pipeline Safety Matters to Everyone April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Our Core Belief - The Connected Path to Greater Pipeline Safety The Public & Local Government Regulators Pipeline Operators April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Speaking for Safety Fearless Independence Carl Weimer, executive director at the industry watchdog Pipeline Safety Trust, said the action was a "dangerous stunt". "Closing valves on major pipelines can have unexpected consequences endangering people and the environment. We do not support this type of action," he said. Quoted in over 300 newspapers April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Nearly Everyone Agrees that Regarding Pipeline Incidents April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Are Trend Lines Going the Right Direction? NEB Regulated Pipelines This equates to a reportable incident every 13 hours for PHMSA pipelines, and one every 3.4 days for NEB pipelines. April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Why Focusing on Zero Incidents is Important Because continuous improvement, safety culture, and safety management systems depend on it April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

While “Zero Incidents” may be the universal goal… There is little consensus on • The definition of “Zero.” • What constitutes an “Incident.” • The preferred timeline to accomplish this. • The priorities. • How much money should be spent to accomplish this. • Whose money to spend. April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Banff Pipeline Workshop - Plenary Address Success in Pipeline Safety is Rarely Black and White, but many Shades of Grey April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Where has the Bar Already Been Raised April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Damage Prevention Efforts April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Damage Prevention Success April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

How Could the Damage Prevention Bar Be Raised Further? Better data collection to drive prevention efforts Simplify process and interface Better enforcement Quit using excavation damage as the boogeyman for all pipeline incidents April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Need to Raise the Bar on Discussing Excavation Damage We still to often hear “Excavation Damage is the leading cause of pipeline incidents…” Causes of All Reported PHMSA 2016 Incidents April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Information and Data Availability Both PHMSA and the NEB have now made a good deal of information available. Some states and provinces are also working hard to be more transparent. Pipeline Industry Associations and individual companies have also started to make more information available Some NGOs and media outlets have also made significant contributions. April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

NEB - Performance Indicators April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Comparisons Made Easy - PHMSA Can easily compare performance between states, companies, pipeline types April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Provincial Initiatives Pipeline Performance Report April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

State Information and Data Availability 2016 Annual Website Transparency Review PHMSA = April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Industry Data and Information April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

CSA Pipeline Safety Metrics Standard Long Overdue effort that will hopefully help rebuild trust: Develop North American metrics for measuring progress on pipeline safety. Standardize information collection and definitions. Agree on common indicators to help better explain pipeline safety to public. Thanks to CEPA for getting this ball rolling, and to CSA for agreeing to carry this forward April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

How Could the Information and Data Availability Bar Be Raised Further? Make it easier to find the information desired Combine much of this information into a GIS based map system Standardize data collection and definitions so information is comparable. Provide all the data so people can verify information being provided April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Bad Information Undermines Trust April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

When Trust But Verify Goes Wrong, or how conspiracy theories are born NEB Incident Data February 2016 NEB Incident Data February 2017 Year Substance Released Volume Released Released Volume Recovered 2013 Condensate 9.1 2 Crude Oil - Sweet 17.8 12 7.7 0.75 4 2.25 1.59 Lube Oil 1.9 2014 173.6 172.3 17 15   5 1.75 Crude Oil - Synthetic 20 2015 30 16 2.3 2.2 Fuel Gas 1 0.769 April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Engaging The Public – Huh? April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Moving Beyond Public Awareness Inclusive Decision Making Active Involvement TRUST Real Communication Public Awareness April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

What’s Wrong With Public Awareness? Nothing, and some companies do it really well, but … • It tends to be one way Communication. • Designed by the industry for the industry with little public involvement. • Tends to tell people what the industry wants them to know, not what they may be interested in. • Whether it successfully changes knowledge or behavior is not measured well. April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Banff Pipeline Workshop - Plenary Address Real Communication Examples of real communication • External Advisory Panels • Partnerships for workshops, tours, discussions • Engaging in community lead panels, investigations, reports April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Community Lead Efforts How to fund? April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Active Involvement & Inclusive Decision Making Few Good Examples • Some Legislative Efforts • Some Technical Committees Lots of Barriers to Active Involvement? • Lack of Access to • Information and Data • Process design • Finances to Participate • Technical Expertise April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address

Really Want To Raise The Bar? Help create more public inclusion and a stronger public interest voice in pipeline safety! Fund an expansion of the Trust or new organizations that provide independent public inclusion - Direct donations - Fund grants or contracts for public interest projects - Fund public participation - Direct fines and settlements to such efforts April 3 - 6, 2017 Banff Pipeline Workshop - Plenary Address
