Fair trial The guarantees of a free trial are that a person has the right to an fair defense, trial by jury, and right to a speedy and public trial It prevents governments from abusing their powers It separates the guilty from the innocent and protects against injustice

Without this right, the rule of law and public faith in the justice system collapse The Right to a Fair Trial is one of the cornerstones of a just society

TrialS A Speedy Trial A Public Trial It is under 6th amendment. A speedy trial is not really defined with the courts, but is necessary in order for an innocent person to spend less time in jail A public trial helps keep the government from abusing its citizens in an unfair trial

Stroble v. California (1961) The murder happened on Monday, November 14, 1949; the victim was a girl that was 6 Stroble was arrested around noon on Thursday, November 17, 1949 Stroble was convicted of first degree murder and sentenced to death. He asked the Court to reverse his conviction as wanting in that due process of law guaranteed against state encroachment by the Fourteenth Amendment

William vs. Florida (1970) William was convicted of robbery in Florida and was sentenced to life imprisonment. Argued: March 4, 1970 Decided: June 22, 1970 Florida has a rule of criminal procedure requiring a defendant who intends to rely on an alibi to disclose to the prosecution the names of his alibi witnesses; the prosecution must, in turn, disclose to the defense the names of witnesses to rebut the alibi At trial, the State used a deposition of petitioner's alibi witness to impeach the witness. Petitioner was convicted, and the appellate court affirmed. Petitioner claims that his Fifth Amendment rights were violated and that his Sixth Amendment right was violated on the ground that the six-man jury deprived him of the right to "trial by jury" under the Sixth Amendment.

Oklahoma City Bombing (April 1995) On April 19, 1995, a truck-bomb explosion outside the Alfred P. Murrah Federal Building in Oklahoma City, Oklahoma, left 168 people dead and hundreds more injured. The blast was set off by anti-government militant Timothy McVeigh, who in 2001 was executed for his crimes. His co-conspirator Terry Nichols received life in prison. Until September 11, 2001, the Oklahoma City bombing was the worst terrorist attack to take place on U.S. soil.

Paul Dennis Reid (1997) Paul Dennis Reid Jr., was convicted of two counts of premeditated first degree murder, two counts of aggravated kidnapping, and one count of aggravated robbery .

Carey vs. Musladin (2006) Matthew Musladin was on trial for the murder of Tom Strudder in California The trial judge denied a defense motion to order the members of the family to remove the buttons, arguing that they could be used to unfairly prejudice the jury, and thus deny Musladin a fair trial by an impartial jury as required by the Sixth Amendment Musladin was convicted, and his conviction was upheld by the California state courts. Musladin then filed a habeas corpus suit in appropriate U.S. District Court

Zender Vs. United States (2006) Jacob Zedner was arrested in 1996 for attempting to open bank accounts with a fake $10 Million bond issued by the fictitious “Ministry of Finance of U.S.A.” The case prolonged over four years in which over time the defendant changed lawyers The trial finally began in 2003 Zender Vs. United States (2006)

Casey Anthony's Murder Trial (June 2008) Casey Anthony, was charged with seven counts -- first-degree murder, aggravated child abuse, aggravated manslaughter of a child and four counts of providing false information to a law enforcement officer in Caylee's(her daughter) in 2008 disappearance and death.

Boston Bombing (April 2013) A jury in Boston voted to Execute Dzhokhar Tsarnasv, ignore his lawyers argument that he was pulled into the plot by his older brother Before his capture, Tsarnaev reportedly scrawled a note inside the boat indicating the Boston bombings were committed in retaliation for U.S. wars in Muslim countries. In July 2013, Dzhokhar Tsarnaev pleaded not guilty to the 30 federal charges against him, including the use of a weapon of mass destruction resulting in death. He was then held in a federal prison in Massachusetts and was scheduled to stand trial in November 2014

Charlestown Church Shooter (2016) Dylann Roof, was charged with hate crimes and obstruction of religion in the Charleston church massacre. He sat in a federal courtroom Monday looking down and generally avoiding eye contact with the potential jurors who could sentence him to death He faced 33 federal counts.

Derrick Rose Rape Case (2013) LAPD confirmed in a letter to Rose’s accuser ( ex girlfriend ) that there is an active investigation into the August 2013 incident in which the 30-year-old woman claims Derrick Ross and two of his friends raped her while she was incapacitated after a night of drinking.
