IMPLEMENTATION OF REGULATORY IMPACT ANALYSIS AND THE PILOT PROJECT IN TURKEY By Dr. Recep KIZILCIK Governer İSTANBUL November 20,2007

Introduction Better Regulation is a key to improve public management, intagration with the global markets and enhance the capacity of competition The Strategy of Better Regulation has become a very important instrument to achieve a successfull accession processe and then converging policies with that of the EU. Implementation of Regulatory Impact Analysis and other instruments of Better Regulation are to take time. To implement RIA requires continuing political support and ownership of bureaucracy. Each of these decisions involves trade-offs and many possible solutions. How do you tackle the process of deciding what action to take? Enhancing the capacities of regulators to choose efficient regulatory solutions consistent with market needs will reduce the risks of costly mistakes and market failures in Ukraine. In the current transition phase, when markets are changing quickly, the risk of making bad regulatory decisions is very high. Investors in Ukraine cite many cases where laws were adopted without clear understanding of market impacts. Like any other country, Ukraine’s ministries must answer questions about the impact of the decisions they make, before they make them. The method used by most OECD countries to assess potential market impacts in advance is regulatory impact analysis.

THE PROCESS OF RIA IN TURKEY The Better Regulation Unit required by the Lizbon Strategy of the EU has been set up in the office of prime minister towards end of 2004. Seminars of Regulatory Impact Analysis are conducted in cooperation with the OECD -SİGMA. Development of RIA, alongside of draft Laws and statury Decrees has been made obligatory by the by-Law which come into effect on February 17, 2006.

PILOT PROJECT The Pilot Project carried out in cooperation with the EU of introducing RIA in to public management aims to; Enhance the capacities of public management, business sector and civil society on RIA Develop draft code of conduct of RIA. Conduct a Action plan of RIA. Carry out a RIA to be dee med as a flag by experts and civil servants. Improve the management of Public Laboratories.

THE STEPS OF RIA Definition of problem. Indentification of aims. Develbent of alternative options of solutions Doing impact analysis. Comparison of alternatives and indentifying the best option. Consultation and participation. İmplementation,monitoring and appraisal.

PROBLEMS FACED Attitude of bureaucracy which does not like to work hard under a time table and programme. Rather then developing alternative ways of solutions , an attitude of bureaucracy which tends to choose one of options undertaken by some body else (i.e external experts, or being implemented by foreign countries) Attitude of bureaucracy which puts benefits of institution for which one work ahead of that of citizens and state.
