WHAT IS IT? A memorandum of agreement between the governmental entity and DEQ to use suitable portions of the waste stream to reclaim and restore damaged land.

WHAT IS CONSIDERED SUITABLE PORTIONS OF THE WASTE STREAM? Material from dilapidated structures Lumber Shingles Plaster / Sheetrock Carpet Brick, metal, rock Glass Etc.

WHAT IS DAMAGED LAND ? environmentally sensitive, nonproductive areas Ravines Gullies Washes Abandoned mining pits Old silage pits Canyons

IS THIS A TYPE OF LANDFILL? NO The land must be damaged and capable of being reclaimed for beneficial use. The acceptable waste material is limited.

APPLICATION SUBMITTAL The application and all required documents are submitted through the Reclamation Specialist to the Land Protection staff attorney for review and routing through the approval process.

MEMORANDUM OF AGREEMENT If the application is approved a memorandum of agreement (MOA), which outlines the conditions of the project, will be drafted. The MOA will then be sent to the governmental entity to be signed by the authorized individual. The conditions are outlined in the fact sheet under the heading “FINE PRINT”.

HOW LONG IS THE AGREEMENT VALID? The site must be properly closed (covered with soil) no later than 120 days from the date material is first placed at the site or 15 days after the last load is delivered to the site, whichever comes first.
